after ko pong maoperahan yung company physician binigyan ako ng fit to work certificate...pero nung e propose na ako ng crewing manager ko sa principal ilang weeks na eh wala pa ring sagot or maybe not approved na ako ayaw lang sabihin ng manager ko...pwede pa ba ako mag file ng full disability even nabigyan na ako ng certificate for fit to work? kung wala ng ibang company na tatanggap sa condition ko maari pa ba akong mag file ng full disability against my company? salamat po...

Naku, I cannot answer your question. Una, hindi ko alam kung ano ang diagnosis sa iyo. Second, usually, after your operation, your doctor will tell you your prognosis (kung gaano ka tagal ka bago maka-resume ng usual activities mo, kung may limitations ang iyong activities habang ikaw ay nagpapagaling, etc. at kung kailangan mo ng follow-up or maintenance medication, etc.).
Third, hindi ko nakita ang fit to work certification sa iyo. fourth, hindi ko alam kung ano ang trabaho mo. Kasi, kung ikaw ay clerk sa isang opisina, kahit may cancer ka, at na-operahan ka, puede ka pang mag-trabaho. Pero, kung halimbawa ikaw ay isang seafarer, aba, ibang usapan na iyan kasi, masyadong physicaly demanding ang trabaho sa barko, bukod dito, malayo masayado sa mga ospital ang mga barko lalo na kung ito ay nasa high seas, kaya, kahit kaya mo nang mag-trabaho, kung kailangan mo ng follow-up or what ever post-operation check-up, baka hindi mo ito magampanan kung ikaw ay nasa- high seas.
Fifth, ang isang shipping company ay nagbabayad ng insurance. Kung may isang miyembro ng crew na hindi talaga fit to work, baka mapeligro ang kanilang insurance coverage. So, talagang hindi ka bibigyan ng trabaho hanggang sa tapos na ang period of recovery.
Masalimuot ang tanong na iyan. You will need an independent physician's opinion. You should get a lawyer and perhaps your lawyer can evaluate whether you can file a case at the NLRC.
