Makukulong ba ako sa 25k na pagkakautang ko?

Makukulong ba ako sa 25 thousand na pagkakautang ko? Nakapaghulog po ako ng 4k pero hindi na po ulit ako nakapaghulog. Yung 25k po ay naging 31k na po kasi po 10% po ang interest nun kada buwan. Sinasabi po nya na maaari po akong makulong sa small claims. Hindi ko naman po sya tinatakbuhan o itinatanggi wala lng po ako sa ngyn na maipapangako. Ano po ba ang mangyayari sa akin? Salamat po.

Siyempre, kapag utang, dapat bayaran. Usually, may interest din kasi, ito ang "bayad" sa pag-gamit ng pera ng iba. Usually din, ang utang ay mayroong kasulatan. Dito nakasaad kung gaano kadalas ang pagbabayad at kung magkano. Kapag hindi nakapag-bayad, usually, mayroong penalty or surcharge para sa late payment.
Ngayon, kung hindi ka makapag-bayad ng ayon sa inyong kasunduan, usually, civil case lang ang puedeng isampang kaso laban sa iyo. Ito ay para makolekta ang principal at ang interest at ang mga penalties and surcharges (kung meron).
Kung nag-issue ng cheke, kung ito'y inihulog sa banko, at tumalbog, puede din mag sampa ng demanda para sa violation of Bouncing Checks Law (B.P. 22) as an alternative to a mere civil case for collection ng utang.
Ang penalty ng pag-i-issue ng bouncing check ay imprisonment of not less than 30 days but not more than one year (per check) OR the payment of fine of double the amount of the check.
Puede din naman na gumawa ng kuwento ang pinag-ka-utangan at sabihin na naloko siya noong umutang kaya't puede din naman siyang magsampa ng estafa (fraud).
Kung simpleng utang lamang, at hindi malikhain ang pinagka-utangan, at sinabi na sa small claims court lang siya magsasampa ng reklamo, ang small claims court are para sa mga maliliit na halagang pera ang kine-claim sa ilalim ng contract of loan. Walang criminal cases ang puedeng i-file sa small claims court.
