I am Anna may question Lang po ako.. Kc po I had an American bf.. That is married to his first wife but he file divorce sa USA.. Ask ko po pwedi po ba kami ikasal sa pinas even tho his not annulled in the Philippines yet and the proof we will gonna use is his USA divorced paper.? Please help me po and if what kind of things he will need to do para makasal kami sa pinas maliban po sa annulment I mean is there anyway than annulment?.

Hi Anna, hintayin mo muna matapos ang divorce proceeding ng American bf mo because you will use that decree of foreign divorce to secure requirements in the Philippines para makapag asa kayo. Some of the requirements for a foreigner to marry are: passport, Certificate of Legal Capacity to Marry (secure it from US embassy in Manila or U.S. Consular Agency in Cebu) usually nagpapasign lang sila ng affidavit in Lieu of the Certificate. Ito ay magpapatunay na walang depikto/hadlang sa kanyang pag aasawa katulad ng kung dati may may asawa na sya sila ay divorce na o kaya namatay na ang asawa na. In relation to this, dapat dala2x ninyo pagpunta sa embassy ang Divorce Decree or Death Certificate ng kanyang asawa. Pagkatapos nito maari na kayong pumunta sa Municipality kung saan nakarehistro ang Birth Certificate mo at kumuha kayo ng marriage license.

OK na po divorce paper nya ma'am na approved na po.. Uuwi sya this year po and 2 weeks Lang po sya gusto nya po makasal kami so kelangan po nmin pumunta sa us embassy here in the Philippines po para masecure ung devorce papers nya and then po dapat po ba sa province nmin po kami ikakasal nakamove napo kc kmi d2 sa cavite po salamat po I'll send him this tips po para malaman nya..

So may chance po na makasal kami even tho his not annulled in his first wife that is Filipina.. And they got married here in the Philippines.. We still have a chance po na makasal kami sa pinas. at hndi po ba malaki gagastusin po Pag NAg PA secure po kmi ng decree of foreign divorce nya.

Ang kukunin lang ninyo sa Embassy yong Certificate of Legal Capacity to Marry (usually affidavit lang ang pinapasign nila doon). Hindi naman nila kailangang magpa annul ng una niyang Filipina wife dahil sapat na ang divorce decree niya bilang isang American citizen dahil divorce naman sa kanilang bansa wala tayo dito. Hindi ko alam kung magkano ang fee for that but hindi naman siguro masyadong mahal.Sa probinsya ka kukuha ng marriage license at kung makuha mo na yan pwede na kayong magpakasal kahit saan lugar sa ating bansa.
