Tenant violated lease contract, did not finish 1 year, so forfeited deposit, padlocked apartment

I would like to seek your advice. Isa po akong may-ari ng isang apartment. Mayroon po kaming isang tenant na nag-violate ng kontrata, di po natapos ang 1 year.

Base po sa kontrata, forfeited po ang deposit. Ngayon po, ayaw umalis ng tenant ng bahay kaya na-padlock po namin ang apartment, ayon sa kontrata pinirmahan namin. Ngayon po lahat ng gamit sa loob ng apartment nakuha ng tenant, pero sabi nya may nawawalang gamit at kinakasuhan kami ng kaso tresspassing at qualified theft. Nasa kontrata po namin pag napadlock po unit, may full power of attorney. The attorney in fact with power of authority to Open/Padlock and take full and complete physical possession and control of premises without the need of court action. Nagka-barangay na po kami pero di po kami nagkaayos.Ngayon po isasampa na po sa korte. Humihingi po ako ng advice sa iyo kung ano po dapat gawin god bless po

Naku po, sa totoo po, kung ang inyong tenant sa paupahan ay hindi tumupad sa usapan, wala kayong karapatang i-padlock ang kanilang tirahan. O i-hold ang kanilang mga gamit. Ang karapatan po ninyo ay mag-file ng kaso for ejectment or unlawful detainer.

Sa totoo po, trespassing po talaga iyon, kasi po, kapag pina-rentahan po ninyo ang isang kuwarto o bahay, ibinibigay inyo ang pansamantalang physical possession doon sa tenant. At kung kinuha po ninyo ang kanilang mga gamit, malamang sa grave coercion po ang isampa sa inyong kaso, kasi, kinuha o hinold ninyo ang kanilang mga gamit para mapilitan silang lumayas o magbayad ng renta.

You need a lawyer. Kailangan dapat ay nagpadala muna kayo ng demand letter doon sa tenant, na sila'y umalis dahil sa hindi na sila nakakabayad. Tapos, bibigyan ninyo sila ng palugit na magbayad or lumayas. At pagka-lampas ng palugit na inyong ibinigay, kailangan kayo'y mag-file ng complaint sa barangay at pag hindi kayo nagkasundo, kayo'y bibigyan ng certification to file action. Saka pa lamang kayo makakapag-hain ng kasong ejectment sa Metropolitan Trial Court. Ito po ay summary proceeding. You need a lawyer, lalo na iyan, kayo ay naunahan na ng inyong tenant at kayo pa ang naka-demanda. You need a lawyer who can defend you when the tenant files the case in court and to file a case against your tenant for ejectment.

Ok lang po ba na doble padlock ko po yung bahay para po pagbalik ng may ari ng gamit ipatawag po kami?ayun po kasi ang pinagawa sa amin sa home owners muna ng nag member po kami.sana po matulungan nyo ako kasi po gusto ko na din po sana magamit yung bahay.

Nagloan po ako ng acquired asset housing loan kaya lang po yung bahay na nakiha ko nakapadlock po at iniwanan ng kaunting gamit ng tumira.yung tumira po kasi nag claim na nabili nila yung bahay sa unang buyer o unang nag loan ng house.paano po ba magandang gawin namin d ko din po kasi alam yung pangalan ng may ari ng mga gamit na nakatira dun at kung asan na sya.kaya po d ko mapatawag sa baranggay.maraming salamat po.
