Ang written incident report at tsaka Affidavit of Loss malakas po bang evidensya yun against my friend? At ino-honor po ba yun sa korte?

Ate/ Kuya, itong tanong mo ay malalim, parang tanong na "May forever ba?" Kasi, kung ang kuko, buhok at fingerprint, dugo at laway ng tao ay puedeng maging ebidensiya, e, di, bakit hindi puedeng maging ebidensiya ang incident report at affidavit of loss?

Kung malakas na ebidensiya ito ay dumedepende kung ano ang layunin sa paghahain ng ebidensiya. Halimbawa, kung ang affidavit of loss ay ihahain sa husgado upang mapatunayan na gumawa nga ng affidavit of loss ang taong nawalan ng ID, ito ay malakas na ebidensiya. Kung ang affidavit of loss ay inihahain upang mapatunayan ang hitsura ng pirma ng tao, eh, puede din itong maging malakas na ebidensiya.

The probative value and the admissibility of any piece of evidence depends largely upon the reason why piece of evidence is being presented. An incident report may be admissible to prove only that an incident was reported. But it cannot be admitted nor can it be given weight to prove the guilt or innocence of the person accused of having committed theft that was alleged in the incident report.

The best thing is, pumunta kayo sa abogado, kayo ay magkonsulta. kasi, para mo akong tinanong nito kung malalim ba ang dagat. Ang sagot, depende. Kung nasa may pampang ka, baka hindi, pero kung halimbawa, nasa gitna ka ng karagatan, malamang sa malalim doon.
