20 years walang komunikasyon sa asawa, gusto ipa-annul. Pwede po ba?

20 years na po ako walang komunikasyon sa dating asawa ko. Gusto ko po ipa-annul ang kasal ko sa dating asawa. May mga kanya kanya na kaming pamilya at may mga anak na rin sa iba ang bawat isa. Matatagalan pa po ba ang proseso ng kaso kapag ipaannul ang married?

I always get questions like this. People think na dahil sa matagal nang panahon ang dumaan na ang mag-asawa ay hindi na nagsasama, puede na silang magpa-annul. Hindi po ganito ang batas.

Ang annulment po na madalas ay naitatanong sa website na ito ay iyong nasa ilalim ng Article 36. Ito po ay ang annulment on the basis of psychological incapacity. Sa ilalim po nitong batas na ito, kailangang maipakita na may PERSONALITY DISORDER ang asawa.

Puede din naman na magpa-declare ng nullity ng kasal kung halimbawa ay ang mag-asawa ay ikinasal noong sila'y wala pa sa wastong edad (18) o hindi kwalipikado ang nagkasal sa kanila.

Puede din namang magpa-annul ng kasal kung halimbawa'y ang pagpapakasal ay dahil sa pananakot, puwersa o inimpluwensiyahan lamang. Kung wala sa mga ito ang kadahilanan kung bakit kayo magpapa-annul, I'm afraid that annulment is not available to you.

Kung halimbawa'y ang napakasalan pala ninyo ay homosexual o di kaya'y may impotence o sterile, hindi po ito mga dahilan para ang kasal ay ma-annul sa ilalim ng Article 36.

Kung halimbawa'y ang napakasalan ninyo ay drug addict pala, o kaya'y nambubugbog o kayo'y sinasaktan, ang mga ebidensiya ng pambubugbog at pananakit ay kulang para mapa-annul ang kasal -- kailangan pang i-prove na may personality disorder (psychological incapacity).

Ang pinaka maganda ay sumulat kayo sa inyong Congressman, at sabihin ninyong, kayo'y pabor sa diborsiyo. Kasi, ang annulment ay hind available sa inyo.
I'm sorry, just because 20 years na kayong hiwalay, at may sari-sarili nang buhay at pamilya -- still this is not a ground for annulment.
