Adoption process, abandonment by biological father

I have 5 years old son and his biological father is no longer communicating or supporting my son for almost 4 years. And now I want to bring my son here. Ive been married to a citizen here for almost 2 years. Do I need the consent of his biological father? Or I just proof to the court of his abandoment of my son? Or what papers do I need to show as a proof of such cases?

I am not so very clear of all the facts:
1. Were you and the biological father of your son married?
2. If you were not married at the time your son was born, did the father sign the affidavit of recognition at the back of the boy's birth certificate?
3. Do you know the whereabouts of the boy's father?
4. Do you know the address of his family (siblings, parents) through whom you may contact him?
5. Are you married in Finland?
6. Does your spouse in Finland want to adopt your son?
7. Does your spouse in Finland have other children?
8. How old are the other children of your spouse?
9. Would they be willing to give their consent (if needed) for their father to adopt your son?

These are some of the questions you will need to answer if you do decide to go ahead and get your son.

Your case may fall under the Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption. RA 8552 and RA 8043.

You might need to file an administrative to declare your child as abandoned by his biological father so that the child will no longer need his biological father's consent to be adopted.

Because I don't have all the facts, I cannot tell you much. Please contact a lawyer, preferably, a lawyer who has some experience with inter-country adoption (if your Finnish spouse wants to adopt your son).

If in case the child is registered as your son and the biological father had not recognized him, he has no parental authority over the child. In order to bring him to Finland, you will just have to comply with Finnish immigration laws. Since he is biologically your child, then, you should have sole custody or your son.

Hi Atty. Were not married of his biological father and also he signed at the back of the certificate. Im married a finnish citizen here and he dont have any other children also..Yes Atty. Both of us planning to adopt my son once we go back to Philippines.
How long will it takes to file for abondment then adoption? If I can find his father, would be easier for the processing of adoption?
