Paano po ang pagproseso sa Pilipinas ng CHANGE OF SURNAME under RA 9255 (AUSF).

Ano ang mga requirements na kailangan sa Pilipinas upang ito ay maiproseso at gaano katagal?

Currently may legal na asawa ang kaibigan ko at gusto nyang maiapelido sa kanya ang bata at pumayag naman ang nanay ng bata na iapelido sa kanya ang bata.

Nakarehistro na yung birth certificate ng bata.

Una sa lahat, ang RA 9255 ay nagbibigay ng karapatan sa mga illegitimate children na papalitan ang surname nila at gamiting ang surname ng kanilang biological father -- IF thier biological father actually recognizes them.

Ganito kasi iyon, noong araw, sa likod ng birth certificate ng bata, kahit na hindi kasal ang mga magulang ng bata, puede pa ring ipa-rehistro ang bata gamit ang pangalan ng ama ng bata bata pumirma sa Affidavit of Recognition ang ama noong bata.

Noong nagka-bisa ang Family Code, hindi na puedeng ipa-rehistro ang illegitimate a child gamit ang pangalan ng ama niya kahit na gusto pa man ng ama na ipa-rehistro ang bata sa pangalan niya.

Siyempre, nasa senado noong sina Ramon Revilla Sr. at si Joseph Estrada. Marami silang mga illegitimate children at sila naman ay nagre-recognize ng kanilang illegitimate children. So, ginawa nila itong batas na ito kaya, ang balik na sa dati, at kahit hindi kasal ang magulang ng bata, ang bata ay puede pa ring ipa-rehistro gamit ang pangalan ng ama basta naka-pirma ang biological father sa affidavit sa likod ng birth certificate.

So, tanong ko, iyong bang surname na gustong ipa-gamit sa bata, iyon ba ay surname ng biological father niya? Kung hindi yung surname ng biological father niya ang nais na gamiting ng bata, then RA 9255 does not apply to your case.

Hindi ko kasi maintindihan sa kuwento mo kung iyong pangalan ng bata ay papapa-palitan at ang gagamitin ng bata ay iyong surname ng legal spouse ng friend mo. Nakita mo kaagad, this law cannot apply in this case, diba?

Una, legal spouse ng friend mo iyon kaya, kung biological child ng legal spouse iyong bata, hindi illegitimate yung bata -- RA 9255 applies only to illegitimate children. Nakita mo?

Pangalawa, kung gusto noong legal spouse ng friend mo na ituring na anak na niya ang biological child ng friend mo (anak sa pagka-dalaga o anak sa pagka-binata), ang dapat na gawin ay legal adoption. Hindi puedeng gamiting ang RA 9255 kung iyong surname na gagamitin ay sa legal spouse.

Puera na lang kung halimbawa, noong ipinanganak ang bata, hindi pa kasal ang biological mother and father noong bata tapos, nagpakasal sila later. In this case, RA 9255 still does not apply. What should be done is the child should be legitimized.

Ang legitimization ay isang administrative action sa part ng Civil Registrar. Ipapakita lamang na noong ipinanganak at ipina rehistro ang bata, hindi pa kasal ang mga magulang niya (so siya ay illegitimate) pero, after siyang maipanganak at maipa-rehistro, di nagtagal, nagpakasal din ang mga magulang niya, so, legitimized siya.

Please go to the Office of the Civil REgistrar (sa Philippine Statistics Office -- iyong dating NSO sa East Avenue). Kung malayo naman kayo sa East Avenue, doon kayo magtanong sa Local Civil Registrar ninyo kung ano ang dapat ninyong gawin.
