Totoo bang pwede na ma-diborsyo sa Pilipinas?

Umuwi po kami ng bf ko sa pinas last December. Nag pa consult po siya sa atty. sa munisipyo nila sa Pampanga kong ano dapat gawin para maghiwalay na sila ng tuluyan ng x niya po.


Kasal po sila nong 1997 then hiwalay sila nong umalis yong babae sa abroad. Then he all know na mag work lang ang babae dun sa ibang bansa pero nalaman niya po eto na may kinakasama na pala ang x wife niya po. Almost 13 yrs na sila hiwalay at walang kuminikasyon.


So now po nag consult siya sa atty. kong ano dapat gawin. Nong last January lang po nag sign po ung bf ko at ung dating asawa niya for separation na wala na silang karapatan sa lahat. And my bf said they sign 1 more paper for divorce both they agree and sign that paper. And waiting for the result of that paper when it will be release and sign for the senate. I dont think so kong true po yun pero bali 3 papers po ung pinirmahan nila dalawa. So now po wait namin ung papel na sinasabi ng bf ko na devorce paper. yan po ang tanong ko atty. kasal po sila and i dont know kong pwede ung papel na pinirmahan nila for divorce.. Kasi po after makuha ung divorce paper magpapakasal po daw kami. Yun lang po gusto ko malinawan sa nakita ko at sa sinasabi niya kasi hindi po ako nakasama nung nagpirmahan sila po ng dating x niya.. Yung papel po na agreement nila may copya po kaming dala and also her x she have also a copy... i want to know kong pwde ba yong sinasabi niya na makasal kami after all what he said...

Abogado po ang gumawa ng mga papeles na iyon? Nagbayad po kayo doon sa abogadong iyon? Mukahang na-scam po kayo.

Una, hindi po puedeng ang mag-asawa ay pumirma ng wala nang paki-alaman sa ari-arian. Dahil po ang taong mag-asawa, kung ila'y mag-asawa, till death po ang kanilang kasal. Wala pa pong divorce dito sa Pilipinas. Wala pong batas na naipasa para sa divorce. Wala pong kapangyarihan ang senado na magsagawa ng batas ukol sa divorce ng iisang tao lamang. Ang divorce po ay isang prosesong legal at itoy sa husgado dumadaan, hindi sa senado. Ang senado po ay gumagawa ng mga batas. At ang lahat ng batas na gagawin ng senado ay kailangan ding dumaan sa Kongreso, at ito'y pipirmahan ng Presidente, at ito'y ilalabas sa mga pahayagan.

There is no divorce in the Philippines. At kung ang Simbahang Katoliko ang masusunod, hanggang sa magunaw ang mundo, walang divorce sa Pilipinas.

Pangalawa, Kung magdi-divorce po ang mag-asawa, kailangan pong mag-hain ng habla at application for divorce sa husgado. hindi puedeng pirmahan lamang ng kontrata o pangako na divorce na sila.

Na-scam po kayo kung totoo ang lahat ng ito. At kung hindi naman totoo, kayo'y pinapa-asa lamang ng inyong boyfriend. There is still no divorce law in the Philippines. You can have your marriage annulled, but an annulment is very difficult to obtain. Taon po ang bibilangin para kayo'y makapag-pa-annul ng isang marriage.

Ang pinaka-maganda po, dalhin po ninyo ang pinirmahan na kontrata o papeles at dalhin po ninyo ito sa Department of Justice or sa Public Attorney's office o kaya sa Integrated Bar of the Philippines. Sila ang makapag-sasabi sa inyo kung lehitimo po ang mga papeles na iyan.

nagbayad ho siya ng 7k po atty. bali yun na po nangyari naghain po ung bf ko ng habla at application for divorce at sinang ayunan naman po ng x wife nia. tas nag pirmahan sila for the custody of there children na buwanan magpapadala bf ko para sa suportahan ung mga bata. naguguluhan po ako atty.
pero aantayin namin ung result nong papel nsa abogado po after po nun may babayaran pa dw siya ulet ndi ko alam kong magkano po.
