Pwede bang gamitin ang surname, apelyido at middle name ng nanay kapag illegitimate siya?

May problema ba if gamit ng illegitimate child ung surname at middle name ng nanay nya?Sabi po kasi pag illegitimate dapat walang middle name na.

Ganito kasi iyon. Kapag ang mga magulang ay hindi kasal na legal, ang anak nila ay illegitimate. The general rule is, the child has to take the middle name and last name noong kanyang ina.

Ngunit, noong naging Senador si Joseph Estrada, dahil nga sa marami siyang illegitimate children, nag-author siya ng batas na naging bill na puede nang dalhin ng anak ang pangalan ng ama kung papayag ang ama na pumirma sa likod ng birth certificate ng bata.

Kapag ginamit noong bata pati iyong middle name noong ina niya, lalabas ay kapatid siya ng kanyang ina, kasi, apelyido noong mother ng kanyang ina iyong middle name. Ang puede lang niyang dalhin ay iyong last name ng kanyang mother.
Sa likod ng birth certificate, mayroong Affidavit of Acknowledgment. Ito iyong affidavit na pipirmahan ng ama ng bata na nagpapatunay na bagamat hindi sila kasal noong ina, kanyang kinikilala na ang batang ito ay kanyang supling.

So, kapag pumirma ang lalaki sa likod ng certificate of life birth ng bata, the child now has the right to bear the father's name.

Atty. ganito sitwasyon ko ngayon.. 1989 ako pinanganak... Middle name at lastname ng mother ko gamit ko. Sa lahat ng records ko,. Blanko name ng father ko sa birthcertificate dahil hndi nmn ako kinilala.. Dapat ko po ba itama ang birthcertificate ko at ipatangal ang middle name ko,, dahil un na ang batas ngayon. Mahiit ang DFA sa Sss naman tinagal nila ang middle name ko dahil lumalabas daw na kapatid ko ang mama ko. Siya kasi ginwa ko benificiarry ko. Ang hirap magayos ng papeles dahil lahat records ko mapapalitan kpg pinatangal ko middle name ko, sana po may mbigay kayo advice ano ang ddapat gaiwn.
