Namatay father, nagsama ng mother common law wife spouse. May karapatan sa ari-arian?

Namatay po ang father ko March 2015.

May unang asawa ang daddy ko at kasal sila. Nagsama sila ng mommy ko (2nd partner) for 16 years which is considered as his common law wife na. May bahay at lupa po kami na nakapangalan sa ama ko, pero nung naghiwalay ang mga magulang ko napag alaman po namin na ipinalipat ng lola ko (father side) sa pangalan niya ang bahay at lupa para hindi namin makuha.

Ano po kaya ang magandang aksyon namin dito? Napagalaman din po namin na lahat ng ari arian ng ama ko ay ibinenta ng lola ko ngunit hndi niya kami binibigyan ng karapatan sa mga ito. Tatlo (3) po kaming mga anak ang naiwan ng daddy ko . Salamat po sa tutugon.

Ganito kasi iyon, kayo ay illegitimate children ng inyong father. Ang may karapatan sa mga ari-arian ng iyong ama ay ang kanyang legitimate spouse, ang kanyang legitimate children at, kanyang illegitimate children. Generally, illegitimate children are supposed to get half the share of a legitimate child. So, kayo ay may parte sa ari-arian ng ama ninyo.

Ang isang kumplikasyon, kung halimbawa ang mga ari-arian na kinamatayan ng tatay mo ay mga ari-arian na nabili niya gamit ang income niya at income ng nanay mo. Kasi, kung ganoon, kahit nasa pangalan ng father mo lang ang mga ari-arian, if your father and your mother had a business (for example) and they shared equally in putting up the capital, they should share also in the profits and in the properties bought with the income they earned in business they shared. So, your mother has to prove how much she contributed toward the purchase of the properties. Thank you very much Madam Atty. Bimbi sa tugon . Napag alaman po kasi namin na yung naging profit ng napagbentahan ng mga ari arian ng father ko e pinasok sa PNB at naka time deposit na. Illegitimate padin po ba kami kahit nakapirma father ko dun sa affidavit of acknowledgement of paternity sa Birth certificates namin?
Salamat po ulit. Lalapit nalang din po kami sa PAO for further process and advice na din po .
