Pagpalit ng Apelyido.

Ano po gagawin namin. Papalitan po kasi ng apelyido yung anak ng kapatid ko. Babae po yung kapatid ko. Apelyido pa po namin yung nakalagay sa pangalan ng anak niya. Gusto po sana namin na isunod na sa apelyido ng tatay niya. Nagpagawa pa po sila ng affidavit of acknowledgment 2012 pero 2014 na po nila nafollow up sa NSO. Sabi po ng NSO sa manila na lang daw po mag follow up.

Teka, parang malabo ang kuwento mo.

Ang kapatid mo ay may anak. Naka-pangalan ang bata sa iyong kapatid pero, ngayon, gusto ninyong ang bata ay i-apelyido sa ama? Tama ba?

Ang ama ay pumirma na ng Affidavit of Recognition? So, gusto ngayon ninyong alamin kung puede nang palitan ang apelyido ng bata?

Naku, naku,noon bang ipinarehistro ang bata sa Civil Registry, eh, hindi pa napipirmahan ng ama ang Affidavit of Recognition? Ibig ko sabihin, hindi pumirma sa likod ng birth certificate ang ama?

Kasi, ang Civil Registrar General ay maaari lamang mag-correct ng typographical errors sa mga birth certificate. Iyong pagpapalit ng apelyido upang ang bata ay magamit ang apelyido ng ama -- that is not a typographical error. That is a significant change kasi, magbabago ang mga karapatan ng bata (may parental authority ang ama niya, may right siya to support from the father, at kung mamatay ang tatay niya, siya ay makapag-mamana sa kanyang ama). So, talagang malaking bagay ito.

So, tama. Dapat ay mag-follow up muna kayo sa NSO. Kung hindi kayo matutulungan ng NSO, you might need to go to court to establish the paternity of the child and to demand that the child be allowed to use his/her father's surname.
