May nakulong na ba sa ra 9262 at 7610 for non supporting? Ano po ba posible maging hatol sa kaso na ito kahit nakakapag support naman sa bata? At gano po ba katagal bago magkaroon ng resuloyon sa kaso na ito? Maari po ba ito madismiss ng fiscal kahit wala naman problema mag support basta magkaroon ng trabaho? Maari ko po ba sila kasuhan dahil sa kanila kaya hindi ako natangap sa trabaho?

Hello, sa ilalim noong dalawang batas na iyong binanggit, isang criminal act ang hindi magsuporta ng asawa o kinakasama at kanilang mga anak. Ito ay isang form ng child abuse o domestic abuse.
Marami na akong nabalitaan na nagsampa ng ganitong kaso. Ngunit, dahil sa ang objective naman ay ang mabigyan ng support ang mga anak, pinipilit ng mga authorities na magkaroon ng amicable settlement.
As for your question if I have heard of anyone who has actually been sentenced for failing to give support, well, no. As usual, this law has very little teeth. It cannot really be enforced especially when the parent who refuses to give support is working abroad. We just do not have the resources to enforce any decision of our courts in other countries.
As in all criminal cases, this requires evidence. Kung walang ebidensiya na may trabaho iyong magulang, paano iyon magbibigay ng support? So, this law looks good in the statute books, but I have yet to hear that it is effectively enforced.
Gayon pa man, if you are facing a criminal complaint of this nature, please secure the services of a lawyer. It is always wise to be represented by a lawyer in any criminal proceedings. It is also wise to take these proceedings seriously.

I'm seperated for 9 yrs now. I have two kids with the custody of my parents since i'm working abroad but right now I'm here in the Philippines. I know that my husband is living with his Mistress and just recently i found out that they already hav son (5 yrs old). Aside from that my husband doesn't support my children for 9 years. Can I file bigamy to my husband? What can u suggest of the best things to do because I am willing to file an annulment too. But if bigamy is much better i would chose bigamy bcoz i want to send him into jail and punish him of what he did. I have photos of them and birthcertificate of the child.
