Tama ba na singilin at habulin ng company, kapag lumabas sa medical na unfit to work? Can company go after me if I'm unfit to work?

Nirecommend po ako ng isang kaibigan sa Company nila sa PNG, prinocess lahat ng document ko don, working permit, at contract, dumating po sa aking yun contract at nagpamedical ako, ngunit lumabas po sa medical na unfit to work. Ngayon po sinisingil po yun nagrecommend sa akin sa lahat ng ginastos nila, ang tanong ko po tama po ba na habulin siya ng Company nila dahil sa pagrerefer nya sa akin at akoy di natuloy sa PNG dahil may sakit ako? Pangalawa ko pong tanong, may pananagutan po ba akong legal sa Kumpanya dahil di ako natuloy. Pangatlo may breach of Contract po ba don, eh di ko naman kagustuhan at di ko alam na may sakit ako. Salamat po at asahan ko po ang inyong tugon. Na sstress na po ako sa kaiisip dahil ginigipit daw po yun kaibigan ko na sa kanya singilin lahat ng gastos nila sa akin. Salamat po Atty. Bimbi

Topic: A friend recommended me to a company in Papua New Guinea. They processed all the documents there, including work permit, contract. The contract was sent here and I had my medical exam, but I was found to be unfit to work. Now I am being charged by the agency who recommended me for all the expenses that they incurred for processing. Does the company have the right to charge me for expenses for referring me, even if I am found to be sick and unfit? Secondly, do I have any legal liability to the company? Is there a breach of contract in this case? It's not my fault that I am sick.

Ganito kasi iyon. Kapag kasi ang agency (hindi kumpanya na direct-hire) ay nagka-gastos sa pag poproseso ng iyong mga papeles, at ikaw ay nakitang unfit to work, dapat ay i-reimburse ang agency.

Ngayon, kung direct hire ang isang OFW (sa totoo, ipinagbabawal sa batas ang direct hire -- itong sa iyo ay parang direct hire kasi wala kang agency kundi iyong kaibigan mong nag-refer sa iyo)ang kumpanya ang nagka-gastos sa pag-po-prosesp mg iyong mga papeles. Iyong kaibigan mo ang parang tumatayong "agency" para sa iyo dahil sa siya ang nag-recruit sa iyo at siya ang gumawa ng mga representation sa employer na ikaw ay maaaring ma-hire nila dahil sa ikaw ay qualified.

Eh, iyon pala'y ikaw ay hindi qualified. Dapat i-reimburse mo iyong agency doon sa nagastos nila na ikaw naman ang nakinabang (hindi ba't nalaman mong may sakit ka -- masamang balita iyon pero, dahil sa nalaman mong may karamdaman ka, maaari kang magpa-gamot. Ito ang kapakinabangan sa iyo noon. Kaya't dapat i-reimburse mo iyong employer sa kanyang pinagka-gastusan.

Mas maiging makipag-usap sa isang abogado na nagse-specialize sa POEA cases at nang mas ma-protektahan ang iyong mga karapatan.
