Kelangan bang bayaran ng employer ang past years contribution ng employee na hindi sa ibang kompanya?

Gusto ko pong humingi ng advice. May driver po akong humihingi ng SSS contribution. Ayon po sakanya 20 years na daw po syang naging driver namin pero year 2005 po ang nakalagay sa biodata nya.


Ang sabi nya po noon meron na daw po syang SSS, so hiningi ko po yung SSS number nya dati para ako nalang magtuloy maghulog. Pero nung nalaman po ng kinakasama nya wala syang makukuhang benepisyo dahil hindi sya ang legal wife, hindi na nito binigay yung SSS number ni driver, kaya di ko po hinulugan.


Sept. 2, 2016 sinabi po nya na pumunta sya sa SSS para magreklamo. Kaya nung kinabukasan pong yon pumunta ako sa SSS. Pinacheck ko po kung SSS member sya which is wala pong lumabas na name nya sa computer nila. Ang sabi po nung empleyado ng SSS, kelangan daw pong bayaran yung contribution ng driver at dipende daw po kung anong year ang gustong ilagay ni driver sa form na fifill-upan nya plus penalty pa daw po. Ang tanong ko po KUNG NGAYONG YEAR 2016 PALANG SYA MAGPAPAMYEMBRO SA SSS, kelangan ko po bang bayaran yung past year contribution nya plus penalty? At pwede nya bang ilagay kung anong year nya gusto (as member)? May batas po ba ukol dito? Sana po may makuha akong advice mula sa inyo. Thank you in Advance

Hello, ang Republic Act 10631 o ang Domestic Workers Act or Kasambahay Act ay naging batas lamang noong 2013. Sa ilalim ng batas na ito, naging mandatory na ipa-rehistro ng mga amo nila ang mga kasambahay at family driver sa ilalim ng SSS, Philhealth at Pag-ibig.

So, kahit na kailan pa nag-umpisa ang inyong driver na nagtrabaho sa inyo (2005 o kailan man), ang karapatan niyang ma-cover ng SSS ay nagsimula lamang noong 2013, noong naging batas ang Domestic Workers Act.

Sa ilalim ng batas na ito, kapag nakapag-trabaho na ng isang buwan ang family driver or kasambahay, dapat silang ipa-rehistro sa SSS. Since nito lamang nagpa-rehistro sa SSS at nito lamang naka-kuha ang inyong driver ng SSS number, makikita na may violation talaga sa batas. kasi, kung driver na ninyo siya noon pang 2013 noong maisa-batas ang Kasambahay Act, then, you should have registered your driver with the SSS as early as 2013.

So, kailangang bayaran ninyo ang SSS na contribution ng inyong driver simula noong naging batas ang Kasambahay Act noong 2013. Prior to 2013, hindi obligatory ang pagpapa-rehistro sa mga kasambahay at family driver. Ito ay voluntary lamang prior to 2013.

Pag pumunta kayo ulit sa SSS, sabihin ninyong ang contribution na dapat ninyong bayaran ay dapat i-compute lamang simula 2013. Pinirmahan ni Pres. Benigno Aquino ang Kasambahay Law noong January 18, 2013. Nailathala sa pahayagan ang batas tapos, after 15 days, o beginning June 3, 2013, the Kasambahay Law took effect.

So, dapat ang computation para sa driver ninyo ay simula lamang noong June 3, 2013. May penalty iyon dahil sa dapat noon pang 2013, may SSS, Philhealth at Pagibig na siya. Seryosohin po ninyo ito, dahil sa mataas ang penalty kung magde-demanda pa ang SSS laban sa inyo ng kasong kriminal. Mas maigi na ang magbayad ng interes at nang penalty kaysa sa ma-demanda pa ng kriminal, di po ba?
