Kapag umurong sa contrata sa trabaho sa abroad, kelangan ba mag-multa sa agency?

Sana po ay matulungan ninyo po kami sa aming issue.


So yung partner ko pa nag apply sa isang agency inofferan po siya ng position as General Cleaner. Nai-submit na po lahat ng kinailangan nilang papers pati medical at naka pirma na rin po ng cotract. Pero wala pa pong ticket at nagkamali pa sila sa pangalan sa visa.


Ngayon po, sa di inaasahan nagkaroon ng problema sa pamilya at gusto ng partner ko na wag na lang tumuloy.


Ano lang po ba ang dapat niyang bayaran? Hindi naman po naka saad sa contrata kung magkano dapat ang bayaran, nakalagay lang doon na if mag reresign ka kelangan mo bayaran ang 1 month salary mo.


Kaso sabi po ng agency need daw mag bayad ng 50K para sa pag cancel ng visa sa Qatar at bayad daw sa ticket ng eroplano (which is sa pagkaka alam namin is wala pa kasi di sila maka bigay ng date of departure).


To add din po.. Automatic po bang maba-ban ng 2 years ang partner ko? Sabihin na nating sometime in the future balakin niya ulit mag apply ng iban trabaho sa Qatar, kelangan nya ba bang mag hintay?

Ganito kasi iyon: kapag naka-pirma na ng employment contract, binding na kasi iyon. Ang problema, kung naka-pirma na ng employment contract, pero, hindi naman na-deploy dahil sa wala pang ticket sa eroplano, hindi naman ang OFW ang may kasalanan noon. Ang isa pa, ang visa ay puedeng itanggi kasi, hindi naman ito ang pangalan ng OFW. Kasi, kung umalis ang OFw na iba ang pangalan sa passport kaysa sa pangalan na nasa visa, baka hindi rin siya maka-pasok sa Qatar.

So, ang dapat na bayaran ay iyon lamang tunay na nagastos ng agency. Kung mali ang pangalan sa visa, ito ay pagkakamali ng agency. Kung wala pang nabiling ticket, hindi dapat bayaran ito.

Kung ang dahilan ng pagbabago ng isip ng OFW ay iyong katagalan bago siya ma-deploy, eh, kasalanan din naman iyon ng agency. So, dapat, the agency should bear the loss.
