Last April 2015, aalis na po sana ako papuntang Dubai. Then nag medical po. Pregnancy test. Nagpositive po ako. So yung agency ko hindi na po ibinalik ang passport ko. Ang sabi po nila kailangan ko daw muna bayaran yung penalty ko bago ko makuha passport ko. Ano po ang gagawin ko? Nakapag bayad din po ako sa kanila almost 12k para sa processing fee. If you have already paid processing fees, this means that there is some sort of agreement between you and your agency. Mayroon ka bang agreement na pinirmahan? Nakalagay ba doon na kapag nag-positive ka sa pregnacy test, ikaw ay dapat na magbayad ng penalty?

Kasi, kung wala kayong ganoong agreement, at bayad ka nanaman ng processing fees, dapat ay isauli sa iyo ang iyong documents. Ano ba kasi ang agreement ninyo? Depende kasi lahat sa agreement ninyo noong agency.

You need a lawyer. Your lawyer must see the documents you signed with your agency. And then, your lawyer will be able to tell you what your rights are -- he or she can tell you what you need to do to get back the processing fee you paid (minus the penalty and all that the agency has already spent to process your documents), and to get your documents.
