Dapat bang bayaran ang trainings at medical para ma-withdraw ang documents at passport ko?

Nag apply po ako sa isang agency noong August 21 na nagpost sa Luneta na urgent hiring for Aug 31 deployment.

Nag punta ako ng office nila at nainterview at cinonfirm na for Aug 31 deployment. Natanggap naman ako ng agency at pinapasa mga documents for approval ng principal. After 4 days na approve po ang line up ko sa isang barko nila. Binigyan ako ng medical at traininings at Cyprus endorsement.

Pagkatapos ng training at medical nagkapirma na po ako ng kontrata, pero di pa na-process sa POEA. Na-delay ang Aug 31 na deployment at sabi sa September 10-15 na naman. Pero September 9 nag report ako for follow up at sabi hindi daw ako makakasama sa deployment.

Ngayon nag fofollow up ako sa kanila at hindi pa alam ang schedule para sa deployment ko hanggang ngaun.

Nagtanung ako kung pwede pa mag withdraw ng documents kaso babayaran ko lahat ng training at medical kasama ang Cyprus endorsement.

Dapat ko po bang bayaran ang mga trainings at medical para ma withdraw aking mga documents? Hanggang kelan ba ako dapat maghintay bago ko pwedeng kunin mga papeles ko?

Ang maikling sagot sa iyong katanungan ay: it depends.

It depends if mayroon kang pinirmahan sa kanila na contract of employment or any other agreement kung saan kayo'y mayroong kasunduan na magbabayad ka ng pera para sa training at sila naman ay nangangakong ikaw ay i-deploy sa petsand kanilang unang ibinigay sa iyo.

Kung mayroon kayong kasunduang pinirmahan, iyong terms and conditions ng inyong agreement and kailangang masunod. Kung wala naman, at ang cost ng training ay dapat na i-salary deduction sa iyo, their failure to deploy you as they promised is ground for you to cancel your agreement with them. Lalo na't hindi naman ikaw ang may dahilan kung bakit hindi ka ma-deploy. Ang problema ata ay nasa sa kanila.

Sa totoo, ang nangyayari, nagba-block-list ang mga employment agencies. Hindi ka maka-ka-alis kung sa ibang agency ka mag-apply matapos mong makuha ang iyong mga documents. Pipilitin ka nilang bayaran ang cost ng iyong training.

It is best to hire a lawyer before ka gumawa ng anumang hakbang.
