Nangako po ang agency ko ng sweldo ko dito sa company ko na aabot sa 6,000sar to 7,000sar, kaso hindi pala totoo at yung 1,875 + 300 na sweldo naging 1,000 + 300 nalang.. ngayon po sinabihan ko na pauwiin nila ako at sinabi na mag file kana ng resignation, nag file na po ako kahapon, at biglang umatras ang agency dahil malaki daw babayaran nila sa agency, pano po gagawin ko? Gusto ko na umuwi dahil wala ako kikitain dito

Ang nangyari sa iyo ay isang breach ng employment contract. Kasi, diba, nag-file ng job contract sa POEA ang agency at nagpa-approve sila ng job contract? Nilagay nila doon kung ano ang pangako nilang suweldo mo sana diyan kung kaya ikaw ay pumayag.

Ngayon, pag dating mo diyan, iba pala ang suweldong ibinigay sa iyo -- iyan ay isang cause of action for a money claim. Kasi, sa totoo, bawal na mangako ng suweldo tapos, hindi naman ito ibigay. Exploitative kasi iyon.

So, dapat ay magpa-repatriate ka. Kung ikaw ang gagastos ng iyong pamasahe pauwi dito sa Pilipinas, pag dating mo dito, idemanda mo ang iyong agency. Sila ang may kasalanan na ikaw ay hindi binayaran ng tama. Ang problema niyan, pumirma ka ng resignation (hindi ko alam kung ano ang nilagay mong dahil at nagresign ka). Iyon ang gagamitin ng agency laban sa iyo dito sa Pilipinas kapag nag-demanda ka sa NLRC laban sa kanila.

You can file a case for illegal dismissal at the NLRC. Because your employment contract was violated. Huwag mo lang kalimutan na ilakip ang contract of employment na pinirmahan mo -- ito ang basis mo ng mga claims mo. Kung may kopya ka ng payslip mo, na maipapakita na mas mababa ang sinuweldo mo kaysa doon sa nasa kontrata ninyo,iyon ang basis ng money claims mo.

Komunsulta sa abogado pag-uwi mo sa Pilipinas. Magtanong sa Embassy or sa Labor Attache na pinakamalapit sa inyo.
