Pwede po bang kasuhan ang employer kapag wala silang pinapirmahang contract or for regularization? Lagpas 1 year na po ako sa employer.

Actually, ang isang empleyado ay kinukunsidera ng batas na "regular" kung ang kanyang trabaho ay "usually necessary and desirable in the usual course of trade and business" ng isang kumpanya o isang employer.

Halimbawa, kung ikaw ay kahera sa isang tindahan, o sekretarya sa isang tanggapan, o nars sa isang ospital, o teacher sa isang paaralan, ang trabaho mo ay isang regular na trabaho dahil sa ang trabahong ginagampanan mo ay kalimitang kailangan at kanais-nais sa regular na takbo ng hanap-buhay ng iyong employer.

Kahit na wala kayong employment contract, o kahit na may employment contract kayo for 5 months lamang (iyong tinatawag na ENDO), kung ang trabaho mo ay regular employment dahil sa ito'y usually necessary in the regular course of trade or business of an employer, the law considers you a regular employee.

Bilang regular na empleyado sa ilalim ng batas, hindi ka basta-basta puedeng tanggalin sa trabaho. Ikaw ay may security of tenure. Ibig sabihin, maaari ka lamang tanggalin sa trabaho kung mayroong just cause (karampatang kadahilanan) at kung ng pagtatanggal sa iyo ay naaayon sa due process (karampatang proseso ng batas).

Nasasa-iyo kung gusto mong maghabla sa NLRC para ikaw ay ma-regularize. Pero, kung ako sa iyo, kung ikaw ay hindi naman tinatanggal pa, huwag ka na munang pumalag. Basta wasto ang pasuweldo at benepisyo, at walang aberiya, bakit ka naman maghahabla (mahirap din namang humanap ng trabaho). Ngayon, kung ikaw ay sasabihan na huwag na lang pumasok dahil sa tapos na ang 6 months mo, o kaya'y gawan ka ng usap para ikaw ay paalisin na, iba nang usapan iyan.

Maaaring illegal dismissal iyan o dikaya'y constructive dismissal. Komunsulta ka na sa isang abogado na ang specialization ay labor law. Ang mga opisina ng Public Attorney's Office ay nagha-handle din ng mga kaso sa labor. So, puede kang komunsulta sa kanila. Puede ka din namang mag-inquire sa pinaka-malapit na opisina ng Integrated Bar of the Philippines. May free legal assistance din sila.
