Pwede ko ba i-double padlock ang housing loan acquired asset na kline-claim ng first buyer?

Ano po bang pwedeng gawin? Nag loan po ako ng housing loan acquired asset po. Kaya lang po hindi namin magamit yung bahay kasi po naka padlock at iniwanan ng gamit ng dating tumira. At hindi ko na po mahanap at makontak yun dating nakatira. Ang sabi po ng mga kapit bahay na claim ng tumira na nabili nila yung bahay sa 1st buyer o unang nagloan ng ba bahay. May karapatan po ba ako sirain ang padlock na nilagay nila o i doble padlock ko po para po pag bumalik nila magkausap po kami?

Naku, I really cannot answer you definitely. In the first place, if this is an acquired asset from a bank, the bank must have foreclosed the property. And if the bank has foreclosed the property, the first buyer did not have the right to sell the property to another person without the consent of the bank.

Kasi, in effect, hindi magiging acquired asset ng banko iyan kung hindi at iyong unang may-ari ay nag-loan din sa banko at iprinenda ang bahay bilang panagot or collateral doon sa loan. Kung ang bahay ay ibinenta noong unang may-ari sa iba, kailangan ng knowledge at consent ng banko kasi, aakuin noong bumili iyong responsibilidad na bayaran iyong loan sa banko. So, magke-credit investigation pa ang banko to see kung iyong buyer ay talagang magandang credit risk.

So, dahil sa na-foreclose na ito ng banko, I can just imagine na ang banko ang nag-pad-lock noong property, noong ito ay na-foreclose. So, dahil sa ikaw na ang nakabili nito mula sa banko, the owner of the property has put you in possession of the property.

You have a right to enter the property. You have a right to use it. Now, you have to store the properties of the former owner because the former owner has the right to retrieve the movable properties they have which were not part of the property that was foreclosed.

So, ilagay na lang ninyo sa isang store room ang mga gamit. Puede na kayong lumipat doon. Kung dumating ang dating may-ari, puede ninyong ibigay ang mga gamit nila, as long as they can produce proof na sila nga ang nag-ma-may-ari sa mga gamit.

Mabuting ipa-blotter ninyo sa barangay at sa pulis. Litratuhan ninyo ang property, litratuhan ninyo ang mga gamit. I-video ninyo ang inyong pag-pasok sa property. Inyong imbentaryuhin ang mga gamit. Ilagay ninyo ito sa isang kuwarto ng bahay. KUng maaari, ay may dating address ang dating may-ari (you can get this from the bank), padalhan ninyo ng liham at sabihin ninyong kuhanin nila ang kanilang mga gamit.

Maraming salamat po sa reply nyo.nakuha ko po ang bahay sa pag ibig po,ung nag claim po na may ari ng mga gamit nabili daw po nila 70k ung rights ng bahay sa 1st owner sa pag ibig ng bahay.kinukuha ko po sa kaibigan na kapit bahay ng bahay na nakuha namin ang pangalan at contact no.po ng may ari ng gamit ayaw daw po ipabigay ng may ari.at contact nalang daw po kami pag may abogado na cla kaya wag daw po namin bubuksan ung padlock nila kakasuhan daw po kami ng grave coercion..kaya po natatakot ako nalipatan ung bahay.
