Bubong lumagpas sa lupa ng kapitbahay

Ako po ay nakatira sa compound ng aming angkan. Nagpa-renovate po ako ng bubong ng bahay at sabi ng asawa ng tiyuhin ng aking ama na lumampas daw ang pinagawa kong bubong sa kanilang lupa. Yun pong pathway na pagitan ng aming mga bahay ay sinasabi niya na part pa daw yun ng lupa ng asawa niya na medyo po napatapat ang aking bubong sa may pathway (mga 1/4 po siguro yun lampas).

Pero di naman po nakadikit o nakakasagabal sa kanilang bahay yun bubong ko? Ano po pede ko gawin?

Naku, masalimuot ang iyong kuwento. Una sa lahat, kung kayo'y isan angkan na nakatira sa iisang compound, kung hindi nakasaad ang inyong mga pag-mamay-ari sa rehistro, mag-away man kayo, walang mapapala dahil sa ang may-ari ng lupa (registered owner) lamang ang puedeng magsabi kung kanino ang lupa.

Bali po, kung pare-pareho naman kayo na hindi registered owner, kayo ay may pro-indiviso shares sa mamanahin, pero, hindi ibig sabihin ay alam na ninyo kung aling bahagi ang sa inyo.

So, walang makapag-sasabi na "kanila" ang anumang bahagi ng lupa na hindi naman kayo ang registered owner.

Pangalawa, sa totoo, kung may pathway sa pagitan ng mga bahay ninyo, illegal na ang bubong ninyo ay lumampas doon. Kasi, kapag umulan, ang tubig ulan ay tutulo sa pathway at ang mga dumadaan ay mape-peligro. So, dapat talaga, hindi lalagpas ang bubong ninyo sa pathway. Ang pathway ay "common" areas ng mga nakatira sa compound. So, hindi mo puedeng hayaan na ang bubong mo ay sasakop doon sa "common" areas.

Away ng pamilya iyan at iyan ay walang katapusan. I suggest you consult a lawyer.
