Do I commit copyright infringement and cyber crime if i make a subtitle translation?

Ang copyright infringement ay isang paggamit ng kahit na anong material na may copyright na walang pahintulot ng may-ari, pag-gawa ng kopya nito ay kumita sa pagpapalabas o sa pagpapahayag nito ng walang pahintulot ng may-ari, ang pag-bebenta ng mga material na walang pahintulot ng may-ari, at ang pagpapalabas ng isang material na hindi ibinibigay sa may-ari ang authorship by failing to attribute.

Ngayon, kung lalagyan lamang ng subtitles for personal viewing, hindi siya copyright infringement kung hindi mo naman pagkaka-kitaan ng pera dahil sa ito'y ipapalabas mo ng may-bayad. KUng hindi mo ilalagay na ikaw ang gumawa ng pelikula, hindi din ito copyright infringement.

Kasi, ang tanging gagawin mo lamang ay ilalagay mo ang salin sa Inggles noong mga salitang Tagalog o Pilipino. Sumasailalim ito sa "fair use". Ngayon, kung iyong foreigner ay pinalagyan ng subtitles dahil sa gagawa siya ng maraming DVD copies nito at ito'y ipagbibili, iyong foreigner ang kumita sa pagbebenta ng movie ng walang pahintulot ng may-ari, hindi ikaw. Ang tanging kinita mo lamang ay ang mag-lapat ng salin ng isang material. Hindi mo naman ibinenta ang material, bagkus, iyong lapat na salin sa Inggles ay puede mong maging copyright pa nga kasi, salin mo ito, ito'y katha ng iyong malikhaing isip. Kapag may-ibang taong nag-lapat din ng ibang salin (wari, sa Pranses, sa Aleman o sa Espanol) kanila ang mga saling iyon.
Pero, kung ako sa iyo, it is best to obtain the owner's permission for the translation lalo na kung ipa-publish mo ang translation as your own, para safe.
