Kelangan ba na ma-notaryo ang 10 year Lease Contract ng condo rental para maging legal?

Does a 10 year Lease Contract (condominium rental) need to be notarized to be considered legal? Thank you.

Kasi, pag sinabi mong "legal" -- do you mean to say "valid"? Kasi, ang lease ay puedeng month-to-month at ito ay puedeng oral contract (walang kasulatan). Kung kayo'y may kasulatan (pinirmahan ninyo noong lessor or leasee), ang kasulatan ay binding sa inyong dalawa.

Ngayon, kung gusto mong ang contract ninyo ay maging enforceable (ibig sabihin ay kung ikaw ay palayasin bago pa matapos ang lease ninyo, gusto mong magkaroon ng karapatang magdemanda at maka-kuha ng danyos) kailangang written ang contract, kailangang ito'y notarized.

Notarization makes a private document a public document.

Pero, kahit na walang kasulatan kayong pinirmahan at pinanotaryo, valid pa rin ang isang lease. Iyong na nga lang, kung ang lease ay beyond one year, kailangang in writing and notarized para protektado ang iyong mga karapatan. Or else, ito ay lalabag sa Statute of Frauds at hindi magiging enforceable and lease contract na hindi reduced into writing.

Iyong notarization ng lease contract, hindi naman kailangan para maging valid or enforceable. kaya lang pinanonotaryo ang kontrata, para may isang officer of the court na magsasabing ang mga lagda sa isang dokumento ay iyong ngang mga lagda ng mga taong pumirma doon, at ito'y nasaksihan ng notaryo noong ang mga partido sa kontrata ay pumirma sa harapan niya. Kumbaga, ang notaryo publiko ay isang testigo sa pirmahan ng mga parties sa isang lease.

Kasi nga naman, kung iyong mga kontrata na may kasulatan, kay dali namang baliin at buwagin ng tao, lalo pa kaya iyong wala kayong kasulatan?
