Land Title with two owners

Maaari po ba na dalawa ang land title at magkaiba po ang may-ari base sa titulo ng lupa? Ang kaso po ganito, may mga nakiki-angkin po sa lupa ng magulang ko, mga kamaganak na pinatira. Nakarating na po sa korte ang kaso at may mga napresenta ang kabilang panig na ebidensya na tulad ng: land title (different name), tax declaration. Ang mga ebidensya naman po na hawak namen ay ang mga susmusunod: land title (named after my father), land blueprint dated 1954, tax payment receipt from 1959 - onwards. Malakas po ba ang laban ng aming panig? Salamat po attorney.

Since your case is already in court, your lawyer is the best person to answer your question kung malakas ba ang kaso ninyo.

The general rule is, the first person to have the title registered in his name is the registration that is valid. So, kung mas matanda ang inyong titulo (1954) at ang sa kamag-anak ninyo ay 1975 lang (for example), then, usually, it is the 1954 title that will prevail.

I do not know all the intricacies of your case. I do not know all the facts. I can only give you the general rule. He who registers first is the rightful registered owner. Please talk to your lawyer. He or she would be in the best position to assess your chances of success.
