Anong karapatang ng may-ari ng right of way sa lupa na kasama sa sukat ng binayaran?

Tanong po tungkol sa right of way. Meron pong lupa na 525 square meter ang lola ng asawa ko na hinati sa tatlo bale ang harapan ng lupa. At binayaran na naming mag asawa. At ang right of way para sa 2 lupang na nasa likod ay kasama sa sukat ng binayaran namin. At binabayaran ng tax yearly. Ang right of way ay nasa gilid ng kahabaan ng bahay namin. Gusto ko po sanang palagyan ng gate sa harapan ang right of way para sa aming seguridad dahil ang right of way naman po at para lang sa aming 3 na magkakamag anak at ang kabouan po ng lupa at naka bakod na. Maliban lang sa harapan ng right of way, ang 2 may ari ng bahay sa likuran ay binigyan namin ng susi upang ano mang oras ay makaposk din sila, ngunit madami akong naririnig na hinde sila pabor. Ano po ba ang karapatan ko bilang may ari ng lupa na nag bigay ng right of way?

Naku, you need to talk to a lawyer. Una, hindi ko mailarawan sa isip ko ang physical arrangement ng lupa, at ng mga bahay.

Kayo po ba iyong nasa harap?

Kayo po ang nagbigay ng right of way para sa mga nasa likod ninyo?

Hindi ko po maintindihan ang inyong kuwento. Kaya, hindi ko masabi kung ano ang dapat ninyong gawin.

Tanong ko lang po may nabili akong lupa 500sqm yun din po ang nakalagay sa deed of sales ngayon po ang nilagay nalang sa titulo 457sqm dahil daw po binawas na ang right of way nung Surveyor. Ang dahilan po ng geodetic engr. kaya niya binawas ang right of way kasi nangyari na daw po sa kanya dati sa isang client na di naapprove kasi kailangan daw ibawas ang right of way sa plano ng lupa kaya ganoon na po ang ginawa ng engr. sa lupa na nabili ko.

I read your post again. Kayo pala ang nagbigay ng right of way. Alam po ninyo, ang right of way ay para doon sa nasa likuran ninyo. sila ang may karapatan doon. Ibig kong sabihin, the right of way exists for the benefit of the lot owners at the back of your property. Kasi, if you do not give a right of way, those people in the back cannot get in or out of their property.

If it is for their benefit and not yours, if they don't want a gate placed on it, you cannot do anything about it. Iyon lang sa inyo ang puede ninyong lagyan ng gate. Iyong right of way, you cannot put a gate on it if those in the back do not agree.

As I said, it would be best to talk to a lawyer.

Hello Atty.
Tanong ko lang po nakabili ako ng lupa 500sqm ang seller ang kumuha ng engr. Na magsusukat ngayon binawas po ng engr. Sa 500sqm ang right of way ang nangyare po nabawasan ang 500 ng 43sqm. Ngayon pong nagpatitulo ako ang nilagay na po sa titulo 457sqm nalang. Tama po ba yun na binawas o dapat po na ipaulit ko ang sukat kasi ang rason ng geodetic engr. binawas niya kasi nangyare na po before na may sinukatan siya di naapprove kasi kailangan niya na daw po ibawas ang right of way. Sana po masagot nyo. Thank you po!
