Paano mababawi ang lupa na Land bank sa gobyerno?

Regarding po sa Lupa ng Tatay namin na ini Land Bank po ng mga kapatid ng Tatay ko noong 1984 pa po pala. Na kung saan patay na ang Tatay ko noong 1979. Wala po alam ang nanay ko at kami din kasi po mga bata pa po kami.


Nanay ko pangalan lang po ang alam isulat. At ni piso po wala din po naibigay na pera sa nanay ko at maging sa amin. 22 hectares po ung lupain ng tatay ko. At noong 2010 lang po kami nakauwi doon ng mamatay yung eldest na kapatid ng tatay ko.



Kasi nung buhay pa po sya dipo kami piñapupunta doon at tinitreaten po ang buhay namin. Kahapun po pumunta Sa Brgy namin kahapun ung taga municipyo pati mga engineer po na galing Manila na nagawork po sa DAR at doon namin nalaman na naka land bank po ang lupain ng Tatay namin na hindi alam ng nanay ko maging kami at sinabi ng taga DAR na wala na daw ang Lupa ng tatay ko kay sa government na po daw. Naguguluhan po talaga kami kung anu ang dapat namin gawin. Pa help po atty kung anu gawin namin. Salamat po.

If the land is registered in your father's name, and your father did not consent to the land being mortgaged to the Land Bank, then you have a right to have that mortgage revoked.

Kung patay na ang tatay mo noong ini-utang sa Land Bank ang lupa, you can go to court and say that your father, who is a registered owner could not have consented to it because he was already dead.

So, mapipilitan silang ilabas ang mga documents. Doon mo makikita kung pineke ang pirma ng tatay mo. Ipapasuri ninyo sa NBI kung peke nga ang lagda ng tatay mo. Kung may SPA na nagbibigay ng kapangyarihan sa kapatid ng tatay mo na imortgage ang lupa, well, it depends on the SPA, kasi, kung patay na siya noong na-notaryo ang SPA o nagawa ang SPA, well, then, he could not have signed that SPA.

You need a lawyer. You will need to assert and prove fraud and intimidation (tinakot kayo). You cannot do it except through the courts.
