Makakasuhan ba ng Filipina ang hapon kung divorce na sila ng unang asawa?

Hapon nagpakasal sa isang Filipina dito sa Pilipinas.

One year after naghiwalay. Nag-file ng divorce

After 6 six years, nagpakasal uli sa Filipina dito uli sa Pilipinas.

Ano pwede ikaso ng naunang Filipina sa hapon, kasi nanakot na kapag umuwi ng Pilipinas yun hapon ipapakulong daw.

Possible ba to? Legal naman ang kasal nun 2nd.

Ah, you mean to ask kung puedeng ide-manda ng bigamy iyong Hapon dahil sa may kasal siya noong una sa isang Pilipina, tapos, nag-divorce na siya, tapos, nagpakasal ulit sa Pilipinas sa isa ring Pilipina?

Mahilig naman sa Pilipina ang Hapong ito, oo.

The law on bigamy is a criminal law. It applies to all persons within our territorial jurisdiction. Kaya, kung hindi pa dissolved iyong unang marriage at magpakasal na ulit ang isang tao, dalawa ang valid and legal marriages niya na subsisting, ito ay bigamy.

Iyon nga lang, Philippine laws on marriage apply only to Filipino citizens. Kapag idinemanda mo ang Hapon, ang gagawin niya ay kukuha lamang ng certification mula sa japanese embassy na siya'y divorced na. Ito ay ipapa-annotate lamang doon sa luma o unang marriage certificate, sa katunayan na ang kasal na iyon ay wala na, dissolved na (lusaw na, kumbaga). So, kahit na siya'y mai-demanda mo, may lusot siya -- may legal defense siya na tatanggapin sa husgado.

So, puede mo band idemanda? Sure, why not? Pahirapan mo siya? Walang pipigil sa iyo. Kaso, in the end, the case will be dismissed. The Japanese citizen has already obtained a divorce decree effectively dissolving his marriage. So, he is free to marry again. His embassy will issue him a certificate of no-impediment to marry. So, he will be able to marry again.

It will be best to go and talk to a lawyer. I do not know all the circumstances of your case -- I may be wrong in appreciating it. I cannot give legal advice, I can only tell you what the law is.
