Pwede ba ibenta ng heirs sa ibang buyers ang land title?

Namatay na po yung mama ko. Tapos naka execute siya nang deed of sale sa isang buyer. Ngunit yung title hindi naka pangalan sa kanya. Ngayon yung title ay under na sa mga heirs. Tanong ko: Valid ba yung deed of sale?


Pwede bang ibenta ng mga heirs sa ibang buyer? Dahil naka pangalan na ang title sa kanila.

Naku, if there was a deed of sale that was executed by your mother, that deed of sale should have been annotated at the back of the title. However, as you said, wala sa pangalan ng mama mo ang titulo. Sa ilalim kasi ng batas, walang karapatang mag-benta ng lupa ang isang taong hindi naman registered owner nito, unless na lang na may pinanghahawakan siyang special power of attorney na nagbibigay ng kapangyarihang ibenta ang lupa.

So, kung ang iyong ina ay hindi registered owner ng lupa at wala naman siyag special power of attorney, at ang deed of sale ay hindi nai-rehistro, at hindi naman alam ng mga heirs ang bentahan (hindi kayo naka-pirma bilang witnesses), then, kahit na valid pa iyong deed of sale, hindi ito mabisa -- hindi ito ma-e-enforce laban sa mga registered owner.

Kasi nga, ang Torrens Title system ay dinesenyo para ang titulo ay isang authoritative na evidence ng ownership ng isang pirasong lupain. Kung ang titulo ay wala sa pangalan ng isang tao, kahit na siya pa ang may-ari, iyon pa ring registered owner ang tinatanaw ng batas a tunay na may-ari noong lupa.

So, sa inyong case, if the lot was in somebody else's name and then it was transferred to the heirs, well, ang laban diyan ay sa ebidensiya. Please consult a lawyer. Hindi ko alam ang facts. Hindi ko nabasa ang mga dokumento, hindi ko nakita ang mga ito. I can tell you what the general rules are, but only your lawyer can answer your questions in full. Please get a lawyer.
