Pwede ba o legal ba magpa-utang na 80 percent interest base RA 9474 at 3765?

Nangutang po ako sa isang lending company from PDOS para makaalis po ng bansa pambayad ng placement fee. Nasa Manila na po ako nun at ang co maker ko ay nasa province kaya sila ang nakatanggap ng pera at yung written bills payment ko. Nung naisend na po sakin yung bills ay nagulat aq sa total payments ko. From 45k na inutang ko, naging 72k lahat babayaran ko. Lumalabas po na 80 % per annum lahat ang interest unlike sa sinabi nila na 8 % per annum lang at sila ung lowest interest lending company nationwide. Kaya pala 8% per month ang interest for 10 months na babayaran ko.

Tanung ko lang po legal po ba ito? Kasi nabasa ko sa RA 9474 at RA 3765 yung dapat na interest lang sana na dapat nila ibigay.. tingin ko po kasi may mali sila sa computation nila. At may illegalities. Papanu ko po ba ito maoopen sa kanila. Tulungan niyo po sana ako sa dapat kung gawin. Na hindi naman ako madaya. Salamat po at Godbless sa inyu..

Usurious po ang contract na ito. kasi po, sa ilalim ng batas, ang prevailing rate of legal interest ay 1%.

Tama kayo na nag misrepresent sila na 8% per annum tapos, iyon pala, 10% per month equivalent to 80% per year.

Mayroon pong isang kaso na dinesisyunan ang Supreme Court noong September 17, 2009. Ito po ay iyong kasong Macalinao v. BPI (G.R. No. 175490). May credit card owner na hindi nakapag-bayad ng credit card bills niya. Idinemanda siya ng BPI. Ang nakalagay sa terms and conditions ng credit card, 36%.

Sabi ng Supreme Court, "we are of the opinion that the interest rate and penalty charge of 3% per month should be equitably reduced to 2% per month or 24% per annum.
Indeed, in the Terms and Conditions Governing the Issuance and Use of the BPI Credit Card, there was a stipulation on the 3% interest rate. Nevertheless, it should be noted that this is not the first time that this Court has considered the interest rate of 36% per annum as excessive and unconscionable."

So, ang batas ay nasa panig ninyo. You will need a lawyer. Please see a lawyer so that you can be advised kung ano ang inyong dapat na gawin.

Maraming salamat po sa inyung sagot atty. bimbi..
What if po kung babayaran q nlng yung inutang q kasama yung 8 percent interes.. at yung sobra pong interes nila ai di q nlng babayaraan..
Nkalagay sa mode of payment q po yung 1st - 7th month ng babayaraan q nakalagay yung pangalan ng banko.. yun po ang exact na dapat bayaraan q with 8% interes.. yung 8th-10th month nmn ay yung sobrang interes nila.. papano po kung hindi q nlng sila nababayaran ng 8-10th month.. may kaso po ba silang maisasampa sakin at sa dalawalang qung comaker nian?
Umaasa po aq sa inyung payu at lubos na ngpapasalamat..
