Carnapped vehicle narecover, pero ayaw i-release ng police sa amin

I have a situation. Our car was lost last February 5, 2017 at Dasmarinas, Cavite City. First or second week of March 2017 (can't remember exact date), while processing important documents required for insurance claim and alarm sheet for carnapping incident, someone informed as that the suspect has been arrested and currently locked up at Makati Police Station and that our car was there also. We immediately go there to confirm the said report. And yes, it's positive, the car was there. The problem is, until now, ayaw po nila i-release yong sasakyan kahit complete naman yong papers/documents na nagpapatunay na sa amen yong unit. We also have a copy of police report na galing sa Cavite where the incident occured, pinakita namen for them to realize and believe us na may report talaga yon na nawawala. Yesterday, while trying to asked them the status of our request, they said, kailangan daw from fiscal yong motion to release. It's been a month na hinahanap namen yong car, very tiring na on our part, yet ito na andyan na sa harap namen yong sasakyan pero hindi pa rin namen makuha. Tama po ba yong sabi nila na dapat from fiscal pa yong motion to release or are they trying to delay lang yong release? I need your advice/opinion on these. Hope to hear from you. Una po sa lahat, ang inyo pong vehicle ay evidence ng crime ng carnapping. So, ito po ay kailangan noong fiscal or prosecutor para mapatunayan na nag-carnap nga ang akusado. Mahalaga ito para mabawasan ang mga carnapper sa Pilipinas, kahit isa lamang.

So, kahit kumpleto na ang papeles ninyo, ito ay nagsasaad lamang na sa inyo nga ang sasakyan. Kayo ang legal owner nito, at kaya nawala ito'y nanakaw ito sa inyo. Have you pressed charges against the accused for having taken your vehicle? Baka kayo'y kailanganin ng Prosecutor na tumestigo para nga makulong ang carnapper.

Sa totoo po, once na ang vehicle ay nakuha mula sa isang akusado o suspect sa carnapping, ang mga vehicle ay nasa pag-iingat ng mga pulis, ngunit, ito po ay under custodia legis -- in the custody of the court.

At tanging ang prosecutor lamang ang makapag-sasabi na hindi na niya kailangan ang vehicle para ito'y ipresinta sa husgado na pruebang carnapper nga ang akusado.

So, dapat ay kausapin ninyo ang prosecutor na nagha-handle ng kaso. I-video tape ninyo ang kotse. Ipakita ang license plate, pati ang chassis at body number. Litratuhan din. Sa gayon, may ebidensiya na ang prosecutor para kahit hindi na ipresinta mismo ang kotse (mahirap naman bitbitin ito ng pulis sa husgado, diba?) mayroong ebidensiya. Tapos, kailangan din sigurong kayo'y gumawa ng habla o statement laban sa carnapper at mangako kayo sa Prosecutor na dadalhin ninyo ang sasakyan when it is required by the court for ocular inspection.

Kung ito'y pinang-hahanap buhy ninyo, isaad ninyo ito. Usually kasi, kailangan na ang sasakyan ay ma-identify muna ng pulis na siyag unit na na-recover nila, at ang litrato ng sasakyan ay ma-identify din ng puli, at pati kayo, kung kayo'y sasalang bilang testigo, kayo din ang mag-a-identify ng sasakyan at noong litrato noong sasakyan.
