Problema sa tubig ng isang tenant

Nangungupahan po ako sa isang apartment. Noong November 2016, natanggap po namin ang aming water bill at nagulat kaming umakyat ito ng 2,400 pesos. Tumawag kami sa water company at nagrequest na imbestigahan namin ito. Hindi dumating ang water bill namin ng December. Pero pinatay namin ang main valve namin mula pasko hanggang New Year dahil umuwi kami sa probinsya. Pagbalik namin ng January, nakuha namin ang water bill namin for December at January at nagulat kami na 8,000 na ang total nito at puputulan na kami dahil hindi kami nakabayad ng 2 buwan (Dec at Jan).


Kinausap namin ang water supplier at sabi nila na ayon sa investigation nila noong Dec 27 (wala kami sa bahay noon) na ang problema daw po ay sa tubo namin. Ayon naman sa landlord ay inayos nila agad ito kinabukasan (Dec 28).

Ngayon, kami po ang pinababayad sa 8,000 na water bill para makabit uli ang tubig. Sinasabi po ng water supplier na hindi na nila jurisdiction iyong sirang tubo dahil private line na daw iyon. Sinasabi naman ng landlord na obligasyon daw namin iyon dahil kami daw yung nandun at bihira lang sila dumaan doon. Underground po ang tubo at hindi po namin nakita o naramdaman na may umaagos na palang tubig. Sino po ang dapat managot? Ano pong aksyon ang pwede naming gawin?

Naku, first of all, siguro naman, dahil nga sa kayo'y sinisingil, dumaan na ang tubig sa kuntador. Ngayon, sa ilalim po ng inyong lease contract, sino ang may obligasyon na mag-repair noong sirang tubo?

Kung pinatay na ninyo iyong main valve noong December, dapat ay hindi na umikot ang kuntador dahil sa wala nang makakapasok pang tubig, and yet, tumaas pang lalo ang bill ninyo? Magulo ito.

Hindi ko alam kung ano ang nilalaman ng contract of lease ninyo. Dapat ay sumangguni kayo sa abogado para malaman ninyo kung sino ang dapat magbayad. Nakaninong pangalan ba ang kuntador ng tubig?Sa inyo? O sa landlord ninyo?

Sa ilalim po ng aming lease contract, structural damages po ay sagot ng landlord, kaya sila po ang nagpaayos ng tubo. Ngunit ang utilities ay sagot ng tenant, kaya po kami ang sinisingil. Kaya ang tanong ko po, kung ang tumagas na tubig ay dahil sa sirang tubo nila, kami parin po ba ang dapat na magbayad? Parang hindi po kasi makatarungan.

Pinatay po namin ang main valve sa loob ng apartment namin. Pero yung tagas ng tubig ay nasa pagitan ng kuntador at ng main valve. Malayo po kasi yung kuntador, nasa 50 meters po ang layo. Sa landlord nakapangalan ang kuntador. Ngayon po pinutulan na kami ng tubig at kahit na bayaran daw namin ang 8,000 (kukunin nila sa aming security deposit) ay hindi na muling ibabalik ng landlord ang tubig namin. Magpakabit na lang daw po kami ng bagong linya. :(
