Promissory Note signed in United Arab Emirates: Can person be sued, if all parties involved are Filipinos?

May query po ako regarding promissory note.

Napirmahan po yung document sa UAE

Pwede po ba kasuhan sa Phils since Filipino po lahat ng party involved?

Ganito kasi iyon. Ang mga contract that involves money or things, basta hindi involved ang mga lupa o bahay or real properties, puede kayong magdemandahan kahit saan ninyo ibigin. Puera na lang kung nakalagay doon sa pinirmahan ninyong contrata na ang mga demanda hinggil sa promissory note ay dapat lamang isampa sa Pilipinas, kahit saan puede kayong magdemandahan. Lalo na't kung payment of money naman ang kontrata.

Usually, kung saan resident ang nagdedemanda, doon siya nagsasampa ng kaso, para nga naman, hindi na siya mamamasahe. Iyong idinemanda na nakatira sa malayo, iyon ang mahihirapan na pumunta sa husgado. Iyong iba naman, nagdedemanda kung saan naroon ang mga properties noong idinidemanda, para nga naman, kung manalo ang nagdemanda, mas madaling mabatak ang mga ari-arian noong idinemanda dahil andoon lang.

P.S., kailangan mo ding isipin iyong capability noong husgado na mag-serve ng notices, summons at subpoena doon sa idinedemanda mo. Ang mga husgado sa Pilipinas, walang kakayanan na magserve ng mga documents at orders ng court kung ang defendant ay nasa ibang bansa -- masyadong mahal ang gagastusin para bigyan mo ng pamasahe ang court personnel na magpapa-receive ng demanda sa idinedemanda mo.

pwede po ba serve ng husgado ang notices, subpoena at summons sa asawa since nandito naman po sa pinas pamilya.
