Pwede po ba ako kasuhan ng malicious mischief ng taong nakaposisyon daw sa lupang nabili ko na may kompletong dokumento, sabi ng lawyer sa PAO?

Pwede po ba ako kasuhan ng malicious mischief ng taong nakaposisyon daw sa lupa na nabili ko na may kompleto namang dokumento gaya ng Titulo, tax declaration, resibo ng amilyar at may deed of sale na din po akong hawak, dahil daw po sa pinalinis ko na ang lupa at pinaputol ko ang mga kahoy. Meron po silang hawak na katibayan daw na may utang yung tatay nung may ari ng lupa dati pero patay na ito, nakalagay daw doon na yung lupang nabili ko ay bayad nung pagkakautang ng ama ng may ari kaya posisyon daw nila yung lupang yun. Ano po dapat kung gawin???? Nagharap po kami knina sa PAO sabi ng atty.pwede daw ako kasuhan ng malicious mischief.

Ganito po kasi iyon. Kapag ang tao ay bibili ng isang lupa, ang kanyang dapat na tignan lamang ay ang Transfer Certificate of Title -- ang TCT. Ang dapat na magbenta at bilhan ng isang lupa ay iyon lamang may-ari o registered owner ng isang pirasong lupa.

If you bought your lot from the registered owner, then the dispute between the registered owner and the person staying on the lot is none of your concern. Wala kang kinalaman sa away nila. Basta ang mahalaga, ikaw ay nagtiwala doon lamang sa TCT na ipinirisenta sa iyo.

Ngayon, ang dapat mong gawin ay mag-file ka ng ejectment. Kasi, ikaw ay transferee ng isang registered owner, you stand in the shoes of the registered owner. Your ownership is as against the whole world. Kaya, puede mo nang i-exercise ang lahat ng rights of ownership including removing all persons na nakatira doon na walang pahintulot mo.

You will need a lawyer for this kasi, maraming jurisdictional requirements para sa ejectment. Find a lawyer to do this for you.

As far as the malicious mischief charge is concerned, this is a crime against property. The only person who can file a malicious mischief charge is the person who owns the property -- who owns the property? Hindi ba iyong registered owner? Kung hindi ang registered owner ang nagtanim ng puno doon, basta labas ka na sa usapan nila kung hindi mo alam iyon. The fact is, you are the owner now because you bought it. If there is anybody who can file a malicious mischief charge, it is you.

You should also seek advice from a lawyer who will be able to see (kasi baka may kasunduan between the registered owner (the one who sold you the lot) and the person who claims ownership of the trees, etc.

Minsan, hindi mapipigilan ang mga tao, they will file a charge against you even if they don't have any right to. But rest assured, you will have a defense under the law. Please get a lawyer who can advice you, a lawyer who can read all the documents relevant to the sale.

Thank you po Atty..Sad lang ako na parang bias yung lawyer sa PAO dito sa Roxas Isabela kasi parang tinatakot niya ako na magfafile daw sila ng case against me dahil pinalinis ko yung nabili kung lupa, ni wala nga pong nakatayong bahay dun kasi parang gubat kaya pinalinis ko po. Nakakawala lang ng tiwala minsan kasi po ganun ang sinasabi ng Lawyer na parang, wala daw akong mapapala sa binili kung lupa kung ayaw ipagalaw ng nakaposisyon samantalang lahat ng documents na nagpapatunay na nabili ko na ang lupang yun..on process na nga din po ang Transfer of Title sa pangalan ko po mismo. Maraming Salamat po ulit Atty.
