ma naghahanap po saken sa dati naming bahay pulis daw po at may kaso ako RA315/318. wala na po ako sa pinas. wala pa rin po ako pambayad kc yung kaibigan ko na nakiride sa cc ko eh namatay na. ano po ang dapat kong gawin? nasa ibang bansa na po ako. natatakot po ako baka di na ako makauwi sa Pinas dahil sa issue na ito.

Naku, ang credit card ay isang personal na credit facility. This means na ang lahat ng credit transactions sa iyong credit card ay iyong responsibility. Even if you only accommodated a friend or a relative, because credit card mo ang ginamit, ikaw pa rin ang magbabayad noon.

The best thing is to get yourself a lawyer. You have to find out kung talaga bang may kaso na laban sa iyo. Kasi, sa totoo, ang maaaring gawin ng isang credit card company ay kolektahin ang utang. Kasi ang utang sa ilalim ng credit card ay isang personal contract o personal obligation.

Ngayon, baka kasi nagsa-side line ang pulis. Para nga naman matakot ang isang nagkaka-utang, maaaring ang collection company ay bayaran ang pulis para sila ang magdala ng collection letter. Hindi naman sa sinisiraan ko ang mga pulis, pero kasi, medyo creative ang mga collection agencies. Baka naman din nagpapanggap lamang na pulis ang pumunta sa bahay ninyo. Hindi natin alam.

It so happens that sa Revised Penal Code, ang Article 315 at 316 ay patungkol sa Fraud or sa Estafa or Swindling. So, baka tinatakot ka lang.

Kasi nga, ang isang credit card ay based sa isang personal na kontrata -- bibigyan ka ng banko ng credit card, usually dahil sa ikaw ay may deposito sa kanilang banko. Tapos, lahat ng bibilhin mo gamit ang credit card mo, pinipirmahan mo at ito ay isang pangako na iyong babayaran ang mga inutang. It is a contract.

The remedy of the bank or the credit card issuer is to collect the sum of money. This is a civil case, not a criminal case. Unless, may proof sila na ikaw ay nanloko, halimbawa, para makuha ang credit card mo, nagpasa ka ng mga papeles na fake (kunwari, fake na certificate of employment or fake na statement of earnings).

Dapat, vinideohan ng mga kamag-anak mo ang pulis. Kunuhanan kaya ito ng litrato, para malaman mo kung tunay nga o fake. Tanungin din ng mga kamag-anak mo kung may Information na ba, o may warrant of arrest na ba -- kasi nga, baka pananakot lamang, para magbayad ka.

Ang pinaka maganda, makipag-usap ka sa credit card company at umpisahan mong bayaran unti-unti ang iyong pagkaka-utang. This is the only way.
