Pwede ba paalisin ng taga squatter and kapwa niyang squatter? Ipapagiba ang bahay

May karapatan ba ang isang taga squatter na paalisin ang kapwa nya squatter?


Ang ngyari po kasi pinatira kami sa lupa ng kamag anak ko. Squatter po yung lugar. Tapos ngayon 2 years pa lang kami gusto na nilang ipa giba yung bahay, kasi raw gagamitin na nila ang lupa. Wala pong titulo ni kahit anong papeles man lang yung KAMAG ANAK NAMIN

Wala akong magagawa o mai-a-advice sa inyo. Kayo po ay parehong in-pari-delicto. Ibig sabihin nito, kayo ay parehong wala sa lugar na matutulungan kayo ng batas. May kasabihan po sa batas na: He who comes to court must come with clean hands.

Ang squatting po ay isang kriminal act. So, wala po kayong karapatan laban sa isa't isa.

Una, iyong taong squatter, iyong kamag-anak ninyo, noong pinatira nila kayo, they gave up the actual and physical possession noong lupa. Ito lang po ang basis ng kaso ng ejectment. Kailangan ay may actual and physical possession iyong nagpatira sa inyo.

Para makapag-paalis sila ng kapwa squatter, kailangan, may maipakita silang karapatan nilang mamalagi sa lupa. Kung wala silang karapatan na mamalagi sa lupa (hindi sila lessee, hindi sila tenant), wala silang karapatan na kayo'y paalisin.

Ngayon kung kayo'y gamitan ng dahas, wala din naman kayong magagawa kundi umalis para hindi kayo masaktan o mapinsala. Mahirap po ang inyong kalagayan. Ang pinaka-maigi ay dumulog kayo sa abogado at nang kayo'y mabigyan ng payong payak sa inyong pangangailangan.
