Paano computation ng separation pay? May makukuha bang separation pay?

My makukuha po akong separation pay at nasa magkano if magresign ako?

Nag start po ako sa work ko last September 24, 2012. Na-regular po ako February 2014. Im planning to resign this coming December 2017? San po dapat mag start ng computation ng separation- date of hired or date of regularizaton? Sana po mabigyan nyo ako ng idea/sagot sa mga katanungan ko. salamat po!

Medyo magulo ang tanong mo. Hindi mo kasi niliwanag kung ikaw ay sa ibang bansa nagta-trabaho o dito lamang sa Pilipinas. Kung dito ka sa Pilipinas nagta-trabaho, ang timano, makalampas ang 6 months, regular employee ka na unless hindi ka nakapasa sa evaluation or probationary period. Kung sa abroad ka nagta-trabaho, ang contrata ninyo ang magsasaad kung kailan ka mare-regularize. The employment contract is the law between the parties.

Pangalawa, ang tanong mo ay paano ko-compute-in ang separation pay. Kung ikaw ay nasa Pilipinas, sa ilalim ng Labor Code, kapag ikaw ay nag-resign, wala kang makukuhang separation pay. Ang separation pay ay danyos na ina-award ng husgado sa isang empleyadong illegally dismissed at hindi na puede pang i-reinstate. So, sa Pilipinas ang mga empleyadong nag-resign ay walang aasahang separation pay. Liban na lamang kung halimbawa, may CBA o contract of employment kayo at nagsasaad ito na may makukuha kayong separation pay kung kayo ay mag-resign. Sa ibang bansa, usually, the contract of employment will state kung may makukuha kang separation pay.

Dahil dito, hindi ko masagot ang iyong katanungan. Kulang kasi ang kuwento mo.
