Yung kapatid ko po ay mag 6mos na po sa trabahong pinapasukan nya under probationary status. Kelan po nya kaya malalaman kung regularized sya or hindi? May 30 days notice po ba ang mga company before ang 6th month nya or mismong araw ng pag 6 mos nya malalaman? Pano po pag wala cnb sknya at biglaan syang sabihan sa mismong araw ng 180 days nya? Salamat po sa sasagot

Under Article 281 of the Labor Code of the Philippines, Art. 281. Probationary Employment. – Probationary employment shall not exceed six (6) months from the date the employee started working, unless it is covered by an apprenticeship agreement stipulating a longer period. The services of an employee who has been engaged on a probationary basis may be terminated for a just cause or when he fails to qualify as a regular employee in accordance with reasonable standards made known by the employer to the employee at the time of his engagement. An employee who is allowed to work after probationary period shall be considered a regular employee. Ibig sabihin pag lumampas na ng 6 months ay magiging regular na employee na sya kailangan magbibigay ng notice ang company either before or on the day of his/her 6months period if if he/she qualifies according to standards to become a regular employee na dapat ipaalam at the time of hiring ng isang employee. So any problem regarding late notice or dismissal beyond this period pwede kayong pumunta sa NLRC office para magpatulong.
