Mga sir tama ba yung sabi ng abogado na pwedeng ibenta yung lupa kahit hindi pumirma yung asawa. Ganito kasi may 2 lote,, 60sqm bawat 1 total of 120sqm,magkatabi separate ng title... Ngayon nagkakalabuan na sila ng asawa nyang babae sa ibang bansa, gusto ng mister na ibenta nya yung 1 lote... Sabi nung abugado wala daw magiging problema dahil hati naman sila dun, yung 1 lote lang pwede nya ibenta. Hindi ba magkakaproblema sa pagtransfer ng tile yun,, kasi 2 sila nakalagay na name sa titulo? Hndi naba sya ilalagay sa deed of sale?

Medyo naguluhan lang ako ng kunti sa separate title ibig mo bang sabihin separate na ang title sa property? For 60sqm sa wife and the other 60sqm for the husband? Well, kung ganyan maari ok na yan lalo na kung ang property regime ng mag asawa ay complete separation o bago pa sila ikinasal ay mayroon silang pre-nuptial agreement na complete separation ang mga property nila. Pero kung hindi maaring conjugal or absolute community of property ang mag apply. Kaya kung ang property na yan ay naipundar during the marriage kailangan pa rin ang consent ng isa't- isa maski sa pagsasangla o kaya pagbibinta.
"ART. 124 of the Family Code. The administration and enjoyment of the conjugal partnership property shall belong to both spouses jointly. In the event that one spouse is incapacitated or otherwise unable to participate in the administration of the conjugal properties, the other spouse may assume sole powers of administration. These powers do not include the powers of disposition or encumbrance which must have the authority of the court or the written consent of the other spouse. In the absence of such authority or consent, the disposition or encumbrance shall be void. xxx. So, kung walang consent the other party ay pwedeng magfile ng nullity of sale.

Sa aking opinyon kailangan pa ring ilagay ang pangalan ng dalawa sa deed of absolute sale at sila ay pipirma nito kasi hindi pa naman napawalang bisa ang kanilang kasal at wala ring order ang court na pwedeng ang isa sa kanila ay pwedeng magbinta ng ari-arian na conjugal or absolute community. Sa bagay pwede naman hindi isali or pepirma ang isa kung talagang ang isa ka kanila ay hindi kokontra nito pero ikaw na buyer ay alam mo na ang magiging risk nito.
