Ok lang po ba kung hindi muna ipalipat saken ung title ng lupa kahit na fully paid ko na po ito? Kasi po wala pang budget pampalipat. Pero nasaken naman po yung titulo na galing sa dating owner? Anu po dpat isaalang-alang kung pede po? May nagsabi po kasi saken na wag ko muna ipa-notary ung Deed of sales para hindi magexpire. Tama po ba yan?

Hindi naman pag-kain na nabibili sa grocery store ang Deed of Sale na sukat magkaroon ng expiry date ang Deed of Sale. Walang expiry date ang Deed of Sale. So, dapat talaga na ipa-notaryo mo ito sa lalong madaling panahon.

Bukod dito, dapat na ipa-rehistro o ipa-annotate mo ang Deed of Sale doon sa likod ng Transfer Certificate of Title na nasa pangalan pa noong dating owner. lalo na't hindi mo pa pala ibig na ipa-lipat na ang titulo sa iyong pangalan.

Ang mainam sa pag-papa-annotate ng Deed of Sale sa Titulo, hindi na ito puedeng ibenta pa ulit noong dating owner. Kung ito'y ialok sa iba, makikita noong pinag-alukan noong lupa na ito pala'y naibenta na, kaya, hindi na malinis ang titulo.

Mientras, kung hindi mo ipapa-rehistro ang Deed of Sale at ito'y hindi mo ipapa-annotate, malinis ang titulo at kung ito'y ibenta ulit sa iba noong registered owner, walang makakapigil sa sale dahil sa wala namang naka-annotate a bentahan.

Pangalawa, ang notaryo ay isang kilos na kailangan upang ang bentahan ng lupa ay maging binding sa lahat ng tao. Ang notaryo kasi ay act that makes a private document a public document. Bukod dito, kung hindi notaryado ang bentahan, baka hindi ito maging enforceable kung sakaling biglang mamatay ang registered owner at ang lupa ay ibenta ng mga tagapag-mana noong registered owner. Puede kasi nilang itanggi ang Deed of Sale.

Pangatlo, ang pagpapalipat sa TCT sa iyong pangalan ay nangangailangan ng surrender noong owner's copy noong TCT. Hindi tatanggapin ng Register of Deeds ang TCT kung ang Deed of Sale ay hindi notaryado. Bukod dito kailangan din na may clearance mula sa Assessor's Office ng munisipyo, probinsiya o ciudad kung saan naroon ang lupa. Ito ay katunayan na bayad ang lahat ng real property taxes. Kailangan din ng clearance mula sa BIR na ang lahat ng taxes (capital gains tax) ay bayad na.

Pag pumunta ka sa Register of Deeds bibigyan ka nila ng checklist ng documents na isa-submit para maipa-lipat mo na ang titulo sa iyong pangalan. Pinaka-maigi, komunsulta sa abogado.
