May isinanlang lupa sa tatay ko 38 years na ang nakakaraan. Ngayon balak nang tubusin ng asawa at mga anak ng may-ari(deceased) ang lupa dahil maganda na ang development ng lupa(bukid),ang problema ay wala itong titulo tanging kasulatan lang na nagpapatunay na isinanla sa tatay ko ng may-ari ang lupa at nagpadagdag pa ng nagpadagdag ng pera noong nabubuhay pa ang may-ari, tanong ko po may karapatan pa ba na makuha ng asawa at ng mga anak ang lupa na isinanla ng mahigit 38 taon na, at ang problema pa po ay wala silang maipakitang kasulatan at sa tatay ko naman po ay hindi na mahanap at wala na ang kasulatang nagpapatunay na sanla ito, kung mahanap naman po ang kasulatan paano naman po nila matutubos ang lupa? The same lang ba ang babayaran nilang pera mula noong nakaraang 38 years pa or babayaran nila sa halaga ng pera ngaung 2021 na? Salamat po sa sasagot *yung lupa po ay pangalan palang ng nanay ng may-ari noon.

Yes, sanla lang naman ang transaction po hindi naman po ito ibenenta sa tatay po ninyo. Kung nawala ang titulo they can ask for certified true copy from Registry of Deeds or magpetitisyon ng Issuance of Loss Title in court para maissuehan sila ng new copy. Kahit po ang titulo ay nakapangalan sa magulang pa ng may ari as long as maestablish nila na heirs po sila may karapatan pa rin sila. Kahit na 38 years na po ang nakalipas ang agreement pa rin na mortage or sanla lang ang mag apply/govern between the parties. Maari namang mag impose kayo ng interest/charges for all the necessary expenses na ginawa para maimprove or madevelop ninyo ang property but kailangang mag agree po kayo nito po at if possible put everything in writing po.
