In the first place collateral lang naman yung nasabing lupa at sa sinabi po ninyong walang titulo ito I am sure hindi rin ito nakaannotate sa title. So I think you need to exhaust the remedy of collection po. File a complaint before the Office of the Barangay at kapag hindi magkaayos humingi nalang po ng certification to file action. You should send a demand letter also asked from lawyer to do so at ipapersonally received mo sa kanya. After that you may file a small claim case in the Municipal Trial Court na malapit po sa inyo no need of a lawyer to assist you in court in this case po.
