Ano po ba ang pwedeng I-counter na kaso ng taong pinagbintangan na nagnakaw?

Hinuli po kasi kahapon March 22 ang bayaw ko sa daan. Pinagbintangan po siyang nagnakaw ng Cellphone noong November 1, 2020 at Pumunta po dito yung nanakawan na may kasamang pulis noong November 6, 2020 kinuha nila lahat ng impormasyon tungkol sa bayaw ko. Since wala naman pong ideya yung bayaw ko binigay niya yung mga hiningi na impormasyon na gusto nilang malaman tulad po ng buong pangalan niya, kapanganakan at Address.. Ang sabi po sa kanya nung araw na 'yon ay Wala lang naman daw po iyon hihingi lang sila ng impormasyon at nagpicture po sila ng nung pulis, pagkatapos na pumunta dito ang mga pulis at yung nanakawan ay pumunta din agad yung tatay ko at ang bayaw ko sa pulis station pero wala naman po silang blotter doon. At pinapanood po sa kanila yung CCTV nakuha pero hindi naman po clear ang Video..At ngayon ang nakalagay po sa Warrant nila is December 10,2020 daw siya nanakawan at nagblotter daw siya nung December 18, 2020. Hindi pa kami nakakuha ng kopya talaga nung totoong blotter nila na nasa log book talaga parang computer type lang. Ano po kaya ang pwede naming gawin since hindi naman totoo yung binibintang nila. Patulong naman po. Thank you

Unang-unang kailangan po ninyo munang mabasa ang complaint, or kaya information at mga supporting dokuments kung bakit may warrant na naissue para sa bayaw mo. Mahirap kasing sabihing walang kasalanan kung may mga ebidensya naman. If talagang may ebidensya wala ka talagang laban sa kanila. Once kasi dumaan na sa Fiscal office at naifile na sa korte ay talagang may probable cause na ang kaso. So sa tingin ko dahil may warrant of arrest na the court has already evaluated the evidence that's why nag issue ng warrant kahit sabihin mo pang walang kasalang wala ka ng action laban sa complainant except mag establish ka na lang ng defense para mapawalang sala ang akusado po.
