Ano po ba ang tamang penalty sa 7 taon na di nabayarang interest sa na sanlang lupa?

Naisanla po kasi ng aking Ina ang minana niyang lupa sa halagang 70,000 at nagkaroon naman po sila ng kasulatan na may interest na 1% kada buwan.  Hanggang sa namatay po ang aking Ama at napabayaan po niya na hindi nabayaran ang tubo at umabot sa 7 taon.  Nagyon po tinawagan ko ang tao na kanilang napagsanlaan ng lupa at sinabi ko na babayaran ko na ang 70,000 na principal at 63,000 na interest.  Ang sagot po niya sa akin kailangan daw po niya patungan ng interest ang 63,000 at aabot po ito sa 204,000.  Tama po ba ang sinasabi niya?  Ano po ba ang legal na penalty sa late payment of interest?  Ano po ba ang dapat ko gawin? Salamat po.

Sa ngayon po dahil suspended ang Usury Law ceiling, it means that the parties are free to agree kung magkano ang interest na dapat i add up as long as hindi ito excessive. Ang kasunduan na yan ang magiging law between the parties. Sa ngayon dahil sa inflation ang interest na 6% per annum ay mag apply yan sa mga loans interests na at the start pa lang walang interest na napag agreehan. In your case sinabi mong 1% percent lang per month maaring reasonable lang din naman yan but if may additional charges na po na hindi napakasunduan ay maari na po ninyong itanong yan at tanggihan. Maari po kayong mag usap sa Barangay muna tungkol diyan kung maaring limited to 1% per month lang ang interest na babayaran ninyo. If not maari po kayong magpetition sa korte na babaan ang mga charges yan kung wala ito sa agreement ninyo po nkasulat.
