May binili po kaming lupa worth 360k bale 50 percent down payment and the rest is for 6 years to pay which is 3k per month. My concern is ang pinanghahawakan lng naming papel from them is DOS na wala pa pong notaryo kasi ipapa notaryo lng dw po yun pag naka full payment n kmi, xerox ng land title mother title po b tawag dun kasi ita transfer plng sa amin then blue print ng lupa from DENR. sapat na po ba yun mga dokumento na yun Kht walang notaryo yun DOS?

Ano po ba ang kahalagahan ng pag babayad sa BIR ng nabiling lupa?
May nabili po kaming lupa at nagpagawa na po kami ng DOS. Compulsory po ba mag bayad sa BIR para sa nabili naming lupa? bakit po may expiration ang DOS? ibig po bang sabihin pag expire na ang DOS at di na po ba pwd evidence ito kung sakaling may mag habol sa nabili naming lupa?

Mahalaga ang pagbabayad ng tax sa BIR sa nabili ninyong lupa dahil nangangailangan po ng tax clearance bago po mailipat ang ang titulo ng seller to buyer. Isa na dito ang Capital Gains tax usually ang seller ang dapat magbayad within 30 days from transaction (from notarization)pero kung hindi kayo nag agree so kayo nalang na buyer ang magbabayad niyan. Wala namang expiration ang DOS kaya lang kapag hindi ninyo ito pinanotarized until such time na mawawala na ang mga parties paano pa po ninyo ito panonotaryohan kung wala na ang buyer/seller medyo mahirap na dahil kailangan personal appearance po ang pagnonotaryo ng mga parties.

magkano po ba ang penalty kapag di nabayaran ang BIR?

Ang nabili po namin na lupa ay may mother title,ang tanong ko po, sakaling esangla sa banko ang mother title at na elite ng banko, kasali po ba ang lupa na nabili namin?

Sa pagpanotaryo kailangang ang personal appearance ng both parties so kung ang deed of sale ninyo ay wala pang notaryo at by the time na magpapanotaryo na kayo wala na ang parties sa contract maaring wala ng lawyer ang tatanggap niyan gagawa na naman ng panibagong deed of sale at mga heirs na ang piperma nito. Tungkol sa surchages/penalty ng BIR mas mabuting sa opisina nila mismo kayo magpaassist may mga examineer naman po sila dalhin lang po ninyo ang mga documents na kailangan like deed of sale. Kung sakaling isangla naman ang mother title at hindi pa napasubdivide yong nabili ninyo maaring masama yan sa naisangla so kailangan patunayan ninyo sa korte na hindi ito kasali kapag naforeclosed ito ng bank.

Ang deed of sale na walang notaryo ay magiging binding lang po ito ng mga parties at hindi sa ibang tao na walang alam sa transaction ninyo. Ang kahalagahan ng notarized DOS is that it converts the private documents into a public documents. Ibig sabihin kung hindi na kailangan magpresenta pa ng iba pang ebidensya regarding its authenticity dahil ito ay being sworn to before at acknowledge before a lawyer. Well, since nagsimula na naman lang kayong nagbayad ngayon pinakaimportante po na you keep all the evidence of payment para sa karagdagan ebidensya ninyo.
