Nandito po ako ngayon sa Japan. Bago po ako dumating dito nagpiyansa na ako at nag-arraign na. Ang kaso po na isinampa laban sa akin ay acts of lasciviousness or panghihipo. hindi po minor age, may asawa na po ung babae. Ngayon nagkasundo na po kami ng babae na iurong na ang kaso. Pero sabi po ng MTC Fiscal sa amin kailangan ko daw bumalik sa Pilipinas para ma provisionnaly dismiss ang kaso ko. Naaayon po ba sa batas yun? Pero sa pagreresearch ko nabasa ko po na maaring gumawa ng consent through writing or viva voice.            Tanong ko po applicable po ba sa sitwasyon ko ngayon ung provisionnaly dissmiss ng kaso? If so paano po ako magsusulat ng consent? Umaasa po ako sa sagot nyo. Maraming salamat

Totoo na puedeng iurong ang asunto laban sa inyo noong complainant sa kasong kriminal. Totoo din po na puede niyang gawin ito sa harap ng husgado. Pero hindi po maaaring wala kayo-- iyon pong viva voce ay inyong boses.

Kasi po, dahil sa kayo ay na-arraign na, kung ang kaso laban sa inyo ay i-atras, hindi na puede pang mag-sampa ng parehong kaso laban sa inyo ang complainant (kaya kailangan ay may consent niya).

pero, ang dismissal po ay "provisional" lamang-- ibig sabihin, hindi pa permanente. Binibigyan po ng husgado ng 2 taon ang complainant para magbago ng kanyang isip at i-revive ang kaso laban sa inyo.

Kaya po, dahil sa provisional ang dismissal ng kaso, kailangan ng inyong consent sa harap ng husgado. Kasi po ay tatanungin ng husgado kung kayo ay papayag. Kung ang complainant ba ay tinakot upang i-atras ang demanda.

Mga ganoong isyu. Kaya po, kailangan pong naroon kayo sa husgado upang inyon ay gawin.
