Hi ! I have 2 illegitimate child.
Kaka4 years old lang nung bata. We were arguing abt sa sustento and pag bisita niya sa bata.

My questions are:
1 Sa case nung dalawang bata since walang participation yung mga tatay nila sa upbringging nila in any form pwede ko ba ituloy yung balak ko na ampunin sila para machange yung last name nila sa last name ko. By the way both of them are under the last name of their fathers
2. If ever na mag change sila ng last name can they still get inheritance from their fathers or benepoisyo lang sa insurance and SSS or anything.
3. How long is the process?. and what are the things that I need to prepare.
By the way Im not yet maarried to anyone.
I hope you can help me.

Kung hindi naman talaga kayo kasal however acknowledged naman ng tatay ang anak mo sa pamamagitan ng pagpirma sa birth certificate hindi basta2x machange ang surname ng bata kundi through filing of petition for change of name in court and you need a lawyer for that. Custody of an illegitimate child is given by law to the mother unless unfit visitation rights lang naman ang sa father nito. Dahil recognized ang anak mo sa kanyang tatay he is liable for support. You can first demand for support as your first step. Well, if you will be able to change their surname dahil mapatunayan mo sa korte na dahil ang anak mo ay hindi naman talaga anak ng ama kahit pa narecognized niya ito then walang karapatan ang anak mo maski sa support at SSS benefits in the future ng tatay.
