Im asking on behalf my bro. he was working last time in phils as sales rep. 2008 ng dubai po siya but nong 2012 my sister in law received a demand letter from his previous company to settle outstanding accounts of 400k.the company offer to settle the account on installment basis by paying 8k monthly but sometimes merong month na hindi nabarayan and for the last few years 5k every other month lang ang naideposit ng misis niya. but last weej a demand letter from the company demanded to settle the whole amount with in 7 days otherwise they will file a case. base n the demand letter i noticed that the 5k they paid on every other month was not deducted on the orig amount of 400k. 1.can they file a case eventhough an installment payment was done every other month? 2.do we really need a lawyer to answer the demand letter? thank you.

The demand letter was send by the company not from collecting agency.

First, a demand letter is just that, a letter of demand. Ibig sabihin, the company is just making a demand.
Second, you can reply to a demand letter by stating how much you had already paid and you can attach photocopies of receipts the company issued to you.
Third, even if you reply to a demand letter or ignore it, the company will still take legal steps to protect its rights.
Fourth, you can even question the amount of 400K -- you can ask the company to explain to you how they arrived at that amount in the first place.
Fifth, since the person who incurred the debt is in Dubai, the letter should be addressed to him, not to his spouse. Kasi, ang idedemanda naman ay ang brother mo, hindi ang wife niya (huwag lang pipirma ng kahit na ano ang wife niya).

Para mapanatag ang loob ninyo, it will be best to consult a lawyer. Pumunta kayo sa Public Attorney's Office para makahingi kayo ng advice.
