Separated from husband for 3 years. Can file annulment?

Ano po ba dapat kong gawin kasi po kasal po ako sa isang pilipino pero 3 years na po kaming hiwalay. May iba na din po siyang kinakasama at ako nman po ay may iba na ding boyfriend pero hindi pa kme nag lilive-in.


Puede po ba kme makapag file ng annulment para nman puede kme mag pakasal ng boy friend ko...?

Hello. Dahil sa kayo ay mga Pilipino, ang batas ng Pilipinas ay sumasaklaw sa inyo kahit saan kayo sa mundo mapadpad. Ibig sabihin nito, kung ang inyong kasal ay may bisa at legal sa Pilipinas, kahit saan pa man kayo lumagi, basta’t kayo’y nananatiling mga mamamayan ng Pilipinas, kayo ay saklaw ng batas ng Pilipinas.

Having said that, ang kasal ay maaaring ipa-annul sa Pilipinas sa iisang ground lamang – ito ang psychological incapacity. Hindi komo’t hiwalay na ang mag-asawa’y ibig sabihin nito’y maari na silang magpa-annul ng kanilang kasal. Kailangang mapatunayang mayroong psychological incapacity ang isa sa mag-asawa para ang kanilang kasal ay mapawalang-bisa.

Hindi biro-biro ang magpa-annul ng kasal. Hindi ito pareho ng divorce na nalulusaw ang marriage dahil lamang sa ang mga mag-asawa ay sawa na sa isa’t-isa o naka-hanap na ng bagong mamahalin. So, dito sa Pilipinas, napaka-higpit ng batas – dadaan sa butas ng karayom bago na-annul ang kasal.

Ang ibang mga Pilipino, nagpapa-citizen muna sa ibang bansa, bago nagpapa-divorce sa bansa kung saan sila citizen na, bago saka pina-rerecognize sa mga husgado sa Pilipinas ang kanilang divorce para sila’y maging malaya na magpakasal muli.
