Kapatid ko po ay Swedish Citizen at kasal sa Swedish pero di po nakaregistered kasal nila sa Pilipinas. Nainlove po sya sa isang pinoy at nagpakasal po sila sa Pilipinas while shes still married to her Swedish husband. Pero that time po on process na ang divorced pappers nila and ngayon po divorced na sya sa Swedish guy. Ang tanong ko po valid po ba ang kasal nya sa pinoy na asawa nya?



Topic: My sibling is a Swedish citizen and married to a Swedish national, but their marriage is not registered in the Philippines. She fell in love with a Filipino and they married in the Philippines, while she is still married to her Swedish husband. But during that time, their divorce papers were already being processed and now they are divorced (with the Swedish guy). My question is, is her marriage to the Filipino still valid?

Strictly speaking, kapag ang isang tao ay hindi pa declared ng husgado na divorced, siya ay married pa sa ilalim ng batas. Kung kaya't siya ay hindi pa puedeng magpa-kasal. At ang kanyang second or subsequent marriage ay masasabing void. Kasi, siya ay may legal impediment na magpa-kasal.

kaso, ang kapatid mo, bagama't Swedish citizen na ay may Pilipino passport pa rin, ano? Kung kaya't noon siya'y nag-apply ng marriage license sa Pilipinas, hindi siya hinanapan ng Certificate of No Marriage o di kaya'y Certificate of no legal impediment to marry mula sa bansang Sweden.

Nga naman, kung tinignan sa NSO na wala pa namang kasal ang kapatid mo na naka-rehistro sa NSO, e, di ibig sabihin ay malaya pa siyang magpa-kasal sa Pilipinas. Itong isyung ito ay tinatawag na conflict of laws. Sa ilalim kasi ng Swedish law, ang kapatid mo'y hindi pa maaaring magpakasal sapagkat kasal pa siya doon sa Swede. Sa ilalim naman ng batas ng Pilipinas, kung saan siya'y citizen din (dahil sa ang mga Pilipino ay maaaring magkaroon ng dual citizenship ngayon), siya'y malayang magpa-kasal dahil sa walang naka-talang kasal siya sa NSO.

Magkakaroon lamang ito ng halaga kung ang kapatid mo ay kailangang patunayan na siya'y kasal sa kahit na sino sa kanyang mga asawa dahil sa siya'y may mamamamana o makukuhang benepisyo. Tiyak na doon lamang ito mauungkat. pero, kung wala namang ganoon, wala namang ibang problema. Sa ilalim ng batas ng Pinas, kasal niya'y legal. Kung dito siya maninirahan, walang problema. Kung siya'y magtatangkang dalhin ang kanyang Pinoy na asawa sa Sweden, at gagamitin niyang ground ay kasal sila, doon magkaka-problema sila. kasi, mauungkat na noong nagpakasal sila, kasal pa siya doon sa Swede. So, made-deny ang application ng kapatid mo na madala ang asawa niya sa Sweden bilang asawa niya. kasi, may discrepancy sa date ng kasal. Buking!
